Tesla Gigafactory Berlin critics’ latest legal efforts fail again

The Berlin-Brandenburg Higher Administrative Court (OVG) inflicted on the fiercest critics of Tesla Gigafactory Berlin, Green League Brandenburg and Nabu their latest defeat. The update was confirmed Thursday by Thorsten Deppner, the lawyer for environmental associations.

The latest efforts by the Green League and Nabu were against the higher court itself, with groups complaining that their grievances against Tesla’s Germany-based installation had not been heard enough. This complaint has now been dismissed by the higher court and the decision has been submitted to the German news agency.

With the Green League and Nabu’s latest loss, Tesla could now continue testing on the Model Y production line at Gigafactory Berlin. This should allow the company to properly tune its equipment, allowing it to start up as soon as it receives its final approval to operate the massive facility. Giga Berlin is expected to start with production of the Model Y, after all, and it’s one of Tesla’s most popular cars to date.

The Green League and Nabu’s recent grievances against Giga Berlin began in June, after Tesla secured early approval to perform limited testing of the facility’s equipment, including its next-generation paint shop. Both environmental organizations strongly opposed Tesla’s early approval of alleged safety concerns, which they took to the Frankfurt Administrative Court (Oder).

The administrative tribunal effectively shot down the efforts of both organizations, and the Green League and Nabu responded by forwarding an urgent petition to the higher court. The OVG, however, quickly rejected the groups’ urgent motion, calling the effort inadmissible. It was this rejection that prompted the Green League and Nabu to complain to the higher court itself, stating that they had not had enough legal hearings and too few opportunities to present their case against Giga Berlin. .

It remains to be seen whether the Green League and Nabu will continue their crusade against Giga Berlin after this point. That being said, Tesla has yet to receive its final approval for the Grnheide-based installation. Until final approval is obtained, Tesla would likely continue to receive the same stream of opposition from groups like the Green League and Nabu. That shouldn’t stop Tesla from getting Giga Berlin ready for Model Y production, however, as the facility is still expected to start operations this year.
