Court documents allege events leading to death of child | Law courts

Recently released court documents have revealed allegations of events leading up to the November 2020 death of a 10-year-old in Andrew County.

Donald Tipton is charged with the child’s death on November 30, 2020. He faces 13 counts, including murder, assault and child abuse or neglect. Booking records show Tipton is currently in Buchanan County Jail awaiting a new hearing in the case.

According to a probable cause statement, officers were sent to a house in southern Andrew County over a report of an unconscious 10-year-old. The victim was transported to Mosaic Life Care and pronounced dead in hospital. The child is identified by initials in court documents.

Tipton told MPs the victim took a bath and was playing video games before finding the child unconscious, court documents show. Tipton told MPs the victim had behaved well during the day but was tired and had two black eyes from a fall the day before. Tipton also told investigators the victim fell earlier today, according to the documents.

Tipton said the child was soft and cold to the touch when he was found, court documents show. Tipton said he took the victim to the child’s mother, who then performed CPR.

However, another child in the house said it was the child who found the victim limp and cold and screamed for Tipton, court documents show. Another child in the house told investigators that the fall on the day of the victim’s death did nothing to [the victim] and suspected Tipton had punched the victim in the previous days, the documents report.

This child also told investigators Tipton threw the victim around the tub, court documents show. When she got out of the tub, the victim made noises and winced, but at one point [the victim] just stopped, said this child. Another child in the house said he saw the victim also being taken out of the tub and the victim was breathing but it was very weak.

According to court documents, Tipton allegedly sent a child to fetch ice four times that day and gave the victim an ice bath. Both children said they received instructions from Tipton on what to say to the victim’s mother and investigators, according to court documents.
