In a letter to US Secretary of Education Miguel Cardona, 14 US senators — including Senator Bernie Sanders (I-VT) and Senator Elizabeth Warren (D-MA) — want the Biden administration to cancel student loans for military personnel. Student loan cancellation if you meet these qualifications

The Biden administration relaxed student loan forgiveness rules, which will result in $4.5 billion in student loan cancellations for student loan borrowers. The Department of Education has announced that $2 billion in student loans will be canceled within weeks. This includes 30,000 new student loan borrowers in addition to the 20,000 student loan borrowers who have already canceled $715 million in student loans in recent weeks. All in all, Biden has now canceled $11.5 billion in student loans since he took office in January. What is driving this increase in student loan waivers? After years of a staggering 98% rejection rate for the public loan forgiveness program, the Biden administration announced major changes to student loan forgiveness, including what student loan payments count toward student loan forgiveness; That types of student loans must count towards student loan forgiveness; which employers? qualify for student loan forgiveness; and when student loan payments start counting for student loan forgiveness. For example:

• past student loan payments for FFELP loans are now eligible;
• past student loan payments for Perkins loans are now eligible;
• past student loan payments that were late or of the wrong amount are now eligible;
• past student loan payments made under the wrong student loan repayment plan are now eligible; and
• for active-duty military service members, deferred and deferred student loan payments are now eligible for student loan forgiveness.

Despite all of these changes in student loan forgiveness, Biden will not cancel student loan payments until the student loan waiver expires on January 31, 2022.

Student Loan Forgiveness: What the Senators Want

The 14 senators want to ensure that active members of the military are forgiven for student loans promised under the public loan forgiveness program. That said, they are not calling on the Biden administration to introduce automatic student loan cancellations for all active military service members. Instead, they advocate:

• Student loan forgiveness for active military personnel, as promised under the new changes to the program, counting student loan payments even if the military is patient or deferred (How to Qualify for Automatic Student Loan Forgiveness);
• Assurances that service employees will not lose federal student aid benefits because of their military service;
• Easing student loans through these changes to help active duty members, veterans and their families so they can plan their financial future;
• The Department of Education to ensure data sharing with the U.S. Department of Defense is quickly implemented so that service employees can receive student loan relief (student loan forgiveness will not be available to everyone, but this plan is available now); and
• The Ministry of Education to codify these regulatory changes.

Currently, these major changes in student loan forgiveness are just: temporary. Before October 31, 2022, student loan borrowers must submit a limited student loan forgiveness waiver to ensure that their previously ineligible student loan payments count toward student loan forgiveness. It will be interesting whether the Biden administration keeps these changes temporary or codifies them permanently.

While members of the military will receive student loan relief through these sweeping changes, all student loan borrowers are required to begin repaying their federal loans from February 1, 2022.
