‘We’ll get back to that’ Alabama senator derails crypto amendment in two words

A compromise that proposed amending the provisions of the bipartisan agreement on crypto infrastructure failed to meet the requirements of a request for unanimous consent in the Senate, making the bill susceptible to being submitted to a full vote without further changes.

This afternoon, Senator Tom Carper, the Democratic Floor Manager for Infrastructure Bill HR 3684, introduced the compromise amendment agreed to earlier today by Senators Pat Toomey, Cynthia Lummis, Rob Portman, Mark Warner, Kyrsten Sinema, and Ron Wyden on clarifying what defines a crypto broker. However, Alabama Senator Richard Shelby objected when Carper refused to add Shelby’s own amendment to the bill, a proposal that would add $ 50 billion to defense funding.

In just two words, I object that the Alabama lawmaker alone appears to have prevented the crypto amendment from being incorporated into the bill before a final vote. While the infrastructure deal could still be changed in the House of Representatives if passed by the Senate, any amendment would require different lawmakers and likely different compromises.

The seemingly fanciful objection did not go unnoticed by Toomey, one of the main supporters of the amendment, who spoke about the possible consequences of leaving the language of the transaction reporting requirements unchanged. The senator said miners, stakes, hardware and software vendors, and software developers would likely be required to provide information they do not have and cannot obtain.

All I want to do is vote on an amendment that fixes this in a way that has a bipartisan agreement, in a way that forces this to apply tightly to the people who are in fact the middlemen, running a centralized exchange, who have this information, says Toomey.

He added:

Well let’s come back to that, because well doing a lot of damage. Who knows how many innovations were going to stifle. Who knows what kind of new apps never emerge. It’s hard to predict what kind of a completely impossible warrant will result, but it’s no good, and it’s going to get us back here trying to clean up a mess we could have avoided.

There is unlikely to be a way forward for the crypto amendment in the Senate until the final vote this week. If the bill passes, it would still have to go through the House before being enacted by President Biden.
