Cryptocurrency advocates and some U.S. policymakers have called for an amendment to the cryptocurrency tax declaration provision in the $ 1,000 billion infrastructure bill.
The provision would require every “broker” to report their cryptocurrency earnings in a 1099-like form. But, critics fear that, as written, the definition of a “broker’s” provision is too broad. . Cryptocurrency advocates fear that the current language could potentially target people without customers who therefore would not have access to the information needed to comply.
These fears are however unjustified, according to an official of the Treasury.
The US Treasury Department will not target non-brokers, such as miners, hardware developers and the like, even if the provision is not changed, a Treasury official told CNBC Make It.
Reporting obligations would only be extended to those who are in a position to comply with them, such as certain decentralized exchanges, for example, if they are enshrined in tax legislation.
But, before establishing the law, the Treasury plans to take the time to do some research to understand who might be asked to comply and check if they would be able to do so, according to the Treasury official. This process could take years.
That’s why investors shouldn’t worry, as Anjali Jariwala, chartered financial planner, certified public accountant and founder of Fit Advisors, previously told CNBC Make It.
The purpose of this bill is more to establish intent than to set out specific rules. “This bill will likely be the first step in further regulation of cryptocurrency,” Jariwala said.
While many in the cryptocurrency space may find it difficult to take the Treasury at its word, the department is clear it has no intention of targeting non-brokers.
