SEC’s decision to seal Hinman’s speech in Ripple case sparks outrage in crypto Twitter

The US SEC has appealed to conceal documents from Hinman’s speech in the ongoing Ripple case, sparking outrage in the crypto community.

What was Hinman’s speech about?

Former director of the corporate finance division at the U.S. Securities and Exchange Commission (SEC), William Hinman, has previously discussed the application of U.S. securities laws to digital assets. His speech is called the Hinman speech when referring to the Ripple-SEC affair.

Speaking at the Yahoo Finance All Markets Summit in 2018, Hinman provided advice on how the SEC would approach the regulation of digital assets, including bitcoin and ethereum. He said, in particular, that digital assets should not be considered as security and therefore be subject to the securities regulatory framework.

In the current case against the SEC, Ripple is using Hinman’s speech as important evidence to clarify how the SEC has approached digital asset regulation.

SEC vs. Ripple: recent developments

On December 22, the SEC filed a motion to seal the documents of Hinman’s speech. In addition, the SEC also requested that the documents be redacted from the defendants’ documents. Some of the SEC takedown requests include identification and credentials of SEC authorities, as well as SEC private and financial data.

The request to delete information about expert witnesses and internal SEC documents comes weeks after Ripple delivered its final litigation against the SEC on December 2. Ripple and the SEC are in a two-year court battle. Their friction also extended to aggressive tweets, with Ripple pointing to SEC oversight of Wells Fargos’ alleged mismanagement of consumer funds.

Ripple and the SEC also filed a joint motion asking for more trial time.

On October 21, Ripple announced that it had obtained access to the Hinman speech documents. Despite this, the SEC insisted that the documents remain secret due to their sensitive nature.

In an earlier case, the courts denied the SEC’s request to keep the Hinman records confidential. The American judge also reproached the SEC for having acted hypocritically by requesting the concealment of probative documents. gimbal

Ripple insists that Hinman’s speech is an important piece of evidence that will help their case with US regulators. Therefore, it should not be withheld and considered irrelevant. Ripple CEO Brad Garlinghouse has mocked SEC Chairman Garry Gensler for suing his company, while completely ignoring the FTX case.

The SEC’s proposal drew criticism from the crypto community and XRP supporters. Some allude to corruption within the agency and claim that Ripple will eventually win the case.

Others are calling for transparency, urging the SEC to make the documents public to US citizens.

The work of the SEC is entitled to the knowledge of American citizens. The SEC oversees what the SEC does because it is paid for by the taxes of the American people. Hinman’s speech should therefore be made public.
