Banque de France Governor Calls on Country to Establish Crypto Regulation Ahead of MiCA

(Kitco News) – Banque de France Governor Francois Villeroy de Galhau has called on the country to step up its oversight of crypto companies that operate alone in the country instead of waiting for European crypto markets to implement. -assets (MiCA), which sets out a framework for how the region will regulate the cryptocurrency industry.

Villeroy’s comments came during a speech on Thursday, where the central bank governor cited the current volatility and downturns in the crypto market as a reason to establish clear regulations as soon as possible.

“The disruption seen in 2022 fuels a core belief: France should move as quickly as possible to mandatory licensing of DASPs (digital asset service providers) rather than simply requiring their registration,” Villeroy said. “And this needs to happen long before MiCA comes into force, to create the necessary framework of trust.”

In November, European Union lawmakers decided to delay voting on the Crypto Asset Markets Bill (MiCA) until February 2023, meaning it will enter into force in February at the earliest. 2024.

The MiCA provisions include the requirement for crypto firms, such as wallet providers and exchanges, to seek permission from national regulators, which is the process France wants to initiate on its own. Currently, obtaining a license for DASP in France is optional. Villeroy wants to make it mandatory for all crypto companies wishing to operate in France.

Currently, the majority of CSPs operating in France do not hold a DASP license. Most have opted instead to use the simplified registration process offered by the country’s financial regulator, the Autorité des Marchés Financiers (AMF).

The November collapse of cryptocurrency exchange FTX led policymakers around the world to call for the rapid establishment of regulations for cryptocurrency businesses in an effort to help protect the public. Many have argued that if the MiCA had already been in effect, it could have lessened the impact of the FTX collapse on Europeans.

In a conversation with the Financial Times (FT), French Senator Hervé Maurey – who is a member of the Finance Committee – said that the collapse of FTX “was a detonation [that] contributed to a moment of awareness and awareness. This led many players in the French system to consider that things needed to be better regulated.

In December, Maurey proposed an amendment to the legislation that would remove a clause that would allow registered cryptocurrency companies to operate domestically without a full regulatory license until 2026. The proposal would require companies to obtain a license from the AMF from October 2023.

According to Maurey, a DASP license would help provide consumers with a higher level of protection and would require crypto companies to disclose more information related to their financial health and control systems.

Maurey’s amendment was eventually passed by the Senate and is expected to be considered by the French parliament in January.
