A top US financial regulator continues to hammer the crypto industry.

Why it matters: The leading lawsuit filed by the Securities and Exchange Commission against Beaxy alleges that the platform has not been registered as a national securities exchange and also challenges its operation.

Driving the news: The SEC on Wednesday accused Beaxy.com, its executives, including founder and former chief Artak Hamazaspyan.

The big picture: SEC enforcement actions appear to be hitting a fever pitch, with major exchanges such as Coinbase and Kraken as well as smaller but well-known crypto leaders like Tron’s Justin Sun in their sights .

What they say: We allege that Beaxy and its affiliates acted as an exchange, broker, clearing agency and trader without registering with the Commission and without comply with clear and proven rules governing such activities, said SEC Chairman Gary Gensler. in a press release.

Details: The SEC also alleges that Beaxy illegally raised $8 million in an unregistered offering of its native Beaxy token (BXY).

And he also accuses Hamazaspyan of embezzling some $900,000 of those funds for personal purposes, including gambling.

What we’re looking at: Windy will go out of business, Beaxy has been shut down, and client assets are supposed to be accounted for and transferred back to them.

Additionally, Windy will destroy all BXYs in her possession.

Zoom In: The Complaint also alleges that Nicholas Murphy and Randolph “Bay” Abbott operated the Beaxy Platform through a company called Windy Inc. Windy also entered into an agreement with Brian Peterson and his companies for market making services.

For all the activities they carried out, the SEC alleges that Windy should have registered as an exchange, but also as a clearing agency, as well as a broker.

Bottom line: Windy, Murphy, Abbott, Peterson and its associated companies, settled without admitting or denying the allegations in the complaint.

They agreed to pay fines.

The Plot: The SEC says it is “pleading” charges against Hamazaspian and Beaxy.
