French officials extend a warm invitation to American crypto companies seeking a more predictable regulatory environment amid uncertainty and repression in the United States.
Currently, France is home to around 74 registered crypto companies, and this number is expected to increase further. While the European Union Rules on Crypto Asset Markets (MiCA) were recently approved by EU ministers, a final round of companies are looking to anticipate the implementation of these regulations. With a regulatory framework that offers relative stability and a supportive ecosystem, the number of registered crypto businesses in France could potentially reach 100.
In France, we are proud to be pioneers with the cryptographic service asset provider regime, known as PSAN, which was legislated in 2019. If American players want to benefit, in the very short term, from the French regime, and from the beginning of 2025 European agreements, it is clear that they are welcome. We have good relations and discussions with our American counterparts, said Benot de Juvigny, secretary general of the Autorité des marchés financiers (AMF).
Amid the changing regulatory landscape in the United States, characterized by heightened scrutiny from the Securities and Exchange Commission (SEC), France’s offer could indeed be enticing for crypto firms. Circle, the issuer of the second-largest stablecoin by market capitalization, is already seeking dual registration in France as it aims to land its flagship product for the European market EUROC, a reserve-backed stablecoin.
Circle is the latest to join the list of crypto firms that have won major regulatory approval in France, and it is following in the footsteps of Binance and Crypto.com. In recent months, brokerage firm eToro and Digital Currency Groups Luno have also registered with Frances AMF.
Despite these claims, cryptocurrency companies will be forced to obtain a full license to operate in France from January 2024 even before the upcoming European regulations come into force. The central bank chief is also backing a proposal from some lawmakers that would remove a grace period the country offers to crypto platforms.
The Governor of the Banque de France has called on lawmakers to start working on new crypto regulations to protect the financial system after the collapse of the FTX exchange. European Central Bank President Christine Lagarde also called on MiCA II to regulate activities related to staking and lending of crypto assets. The term refers to additional legislation building on the work done by lawmakers for the original bill.
Currently, crypto platforms are allowed to operate in the country without a full license until 2026, which means they can provide their services with minimal controls.
