Former U.S. Securities and Exchange Commission (SEC) lawyer John Reed Stark has defended the agency’s current chairman, Gary Gensler, in light of the criticism he has faced in recent months over his approach to cryptocurrency regulation.

Stark says there needs to be a more focused approach to discussing cryptocurrency regulation, urging individuals to focus on the law rather than resorting to attacks on Gensler, he said in a statement. tweeted on June 30.

Stark criticized the tendency to engage in personal attacks, describing them as an “anemic, flawed pivot” that doesn’t hold up in a courtroom and is merely an attempt to incite a mob mentality.

“It’s time to attack the facts and the law on SEC positions and stop personal attacks on the SEC Chairman or SEC staff. He’s an anemic, flawed pivot that doesn’t work in a courtroom and is a transparent, bush-league attempt to rally the crowd,” he said.

Drawing on his time as SEC Bureau Chief of Internet Law Enforcement, where he served for 11 years, Stark emphasized the importance of engaging with industry stakeholders in security to understand their views and stay informed.

Gensler must consult

He clarified that such interactions were within the scope of his job description and did not involve any unethical behavior. Stark asserted that Gensler should benefit from the same principle, as he must also engage with industry representatives to perform his duties effectively.

Stark’s comments were prompted by an article by Jake Chervinsky, Compound Labs’ general counsel, who called on Gensler to recuse himself from making enforcement decisions regarding cryptocurrencies. Chervinsky argued that the SEC Chairman “misjudged that all digital assets are securities.”

In this case, Stark expressed his views by drawing a comparison to the pro-crypto stance of SEC Commissioner Hester Peirce, emphasizing that his beliefs should not require him to recuse himself from questions regarding crypto regulation. -cash. He pointed out that the same principle applies to Gensler.

Stark argued that, like Gensler, Commissioner Peirce had earned her position as SEC commissioner.

“As long as she complies with the ethical requirements, and is a super-ethical lawyer and a thoughtful leader, she deserves to put forward her point of view, her perspective and her positions whenever she wishes,” said he declared.

Starks SEC Defense

Notably, this isn’t the first time Stark has defended Gensler. As reported by Finbold, Stark previously pointed out that the crypto regulatory crackdown in the United States was just beginning and advised investors to exit the market. He expressed his belief that the SEC’s enforcement efforts were precise and targeted.

Stark’s comments come amid ongoing debates and discussions regarding cryptocurrency regulation and the SEC’s role in overseeing this emerging asset class. Notably, Gensler found himself on the side of the crypto community after the SEC sued crypto exchanges Coinbase and Binance for allegedly listing unregistered securities.
