Lawyers – Gary D. Fielder and Ernest John Walker – who filed an election lawsuit in late December 2020 in Colorado federal court must pay attorneys’ fees for Facebook, Dominion Voting Systems, states of Michigan, Pennsylvania, Georgia and Wisconsin, and the non-profit Center for Tech and Civic Life, all of which were named as defendants in the lawsuit, Magistrate Judge N. Reid Neureiter ruled.
Neureiter wrote a painful 68-page opinion condemning the lawsuit after the election, calling it a “massive conspiracy theory” and potentially defamatory. The plaintiff has no lawyers or experts who can support the claims, the judge said.
Wednesday’s decision marks the first major federal court consequence that has befallen the lawyers and litigants who pushed President Donald Trump’s attempt to discredit the 2020 election result in court.
It could also be played out in many other litigation where judges consider reprimands for Trump’s legal teams and his supporters.
The states, Dominion, Facebook and the nonprofit are set to estimate their legal costs later this month so the judge can determine penalty payment amounts.
Fielder and Walker did not immediately comment for this story.
A lawsuit claim that the Dominion withheld votes for Trump is highly controversial, inflammatory and unsubstantiated, the judge also said. Several other lawyers for President Donald Trump and his campaign have repeatedly sued other court cases and faced possible penalties and penalties before other courts, and Dominion has lawsuits for defamation.
“The unique circumstances in this case, including the volatile conditions surrounding the 2020 election, the extremely serious and potentially damaging allegations against public servants and private entities, make the compelling request to declare invalid and ineffective certification of electoral votes by many states, coupled with an extraordinary monetary requirement of $ 160 billion and the absence of any time pressure, means that any reasonable pre -filing investigation is necessary to involve extensive effort and the trial of the allegations, including actually talking to people, such as the lawyers who filed the failed lawsuits and the experts who submitted affidavits.Under the circumstances in this case, the Plaintiffs’ advice did not fulfill this obligation, “the judge wrote.
“Public statements from authoritative sources and courts denying allegations of widespread voter fraud or ballot-rigging should, if not turn red, at least flashing yellow lights that warns the Plaintiffs ’advice to proceed with custody,” Neureiter added. “Instead, they went through the lights at full speed, even speeding.”
