The Trump campaign lost in the arbitration case against Omarosa – Press Enterprise

Former Trump campaign and White House aide Omarosa Manigault Newman has defeated an arbitration case brought against him by the Trump campaign, accusing him of violating a non -disclosure agreement on public comments and a book criticizing former President Donald Trump.

In a summary judgment handed down Monday in Manigault Newman’s favor, the arbitrator denied Trump’s campaign claims, saying the NDA was “overbroad, indefinite, and unreasonable.” The decision marks a rare example of the final and financial consequence in a legal battle chosen by Trump against one of his personal or political enemies.

Arbiter T. Andrew Brown of the American Arbitration Association said in the judgment that the NDA’s terms “exceed what is reasonably expected to protect” Trump’s campaign interests.

The arbitrator said the agreement effectively imposed on Manigault Newman “an obligation not to say anything remotely critical of Mr. Trump, his family, or the businesses of his family members, for the rest of his life.”

“Such a burden is certainly unreasonable,” the judgment said.

The arbitrator pointed to the decision in a federal court case in which another former Trump campaign staffer, Jessica Denson, was seeking a ruling that declared her NDA campaign unenforceable. In that case, a federal judge held in March that certain provisions of the NDA could not be enforced.

The decision in Denson’s case was not binding on the foregoing, the spokesman in the Manigault Newman case noted, but was nonetheless “persuasive and consistent with the principles of New York contract law.”

The Trump campaign filed an arbitration lawsuit in August 2018, the same day as the release of Manigault Newman’s book “Unhinged: An Insiders Account of the Trump White House,” his background view of working for Trump. The summary judgment said that because Manigault Newman had prevailed in the arbitration case, he could now proceed to pay the lawyers.

“Obviously, I am very happy with this decision,” Manigault Newman said in a statement. “Donald has used this kind of offensive litigation to intimidate, harass and bully for years! Finally, the bully has won his fight!”

In a statement given to CNN’s Trump spokesman, the former President did not weigh the merits of the decision, but personally criticized Manigault Newman.

“No one in his life has done more for Omarosa than a man named Donald Trump,” he said. “Unfortunately, like some others, he forgot all about it – which is good for me!”

Manigault Newman’s book, formerly known for his polarizing character on NBC “The Apprentice,” painted a rebellious picture of the former President. In it, he describes a mentally, racist and obscene, charismatic but mentally abusive, a man who oversees a gathering of aides and family members whose diverse goals rarely include the improvement of the country.

Manigault Newman insisted his firing from the White House was because he knew about a possible audio recording of Trump uttering a racial slur, claiming he was the subject of deep distress in the campaigns – and eventually the White House – helpers. Manigault Newman does not provide evidence of suspected recording.

He wrote that he turned down an offer from Trump’s daughter -in -law to sign a non -disclosure agreement in exchange for work on the President’s reelection campaign that pays $ 15,000 per month. The book did not include a copy of the nondisclosure agreement, but The Washington Post said it reviewed it.

Among other things, Manigault Newman, who oversaw the release of American Trump, also recounted occasions he reconsidered his loyalty to the President and administration, particularly in the wake of the White supremacist rally in Charlottesville last August 2017.

“Donald Trump, who will attack civil rights icons and professional athletes, who will chase down grieving black widows, who will say there are good people on both sides, who endorsed an accused child molester; “Donald Trump, and his decisions and behavior, are hurting the country. I can no longer be a part of this madness,” he wrote.

The 2019 lawsuit still pending by the Justice Department filed in federal court alleging that Manigault Newman failed to file a financial disclosure report after he was expelled from the White House in 2017. The judge in that case was fully declared in the DOJ’s motion for summary judgment but has not yet been decided on the motion.
