A Nevada man is facing criminal charges for voting on the ballot of his deceased wife during the 2020 presidential election.

Donald Kirk Hartle has been charged with two felony counts of voter fraud in twice voting, including once in the name of his wife Rosemarie Hartle, Nevada attorney Aaron Ford (D) said in a statement.

Ford said voter fraud is rare but “but if it happens it won’t gain trust in our election system and my office won’t tolerate it.”

Hartle previously told local CBS affiliate KLAS in November that a ballot for Rosemarie Hartle was received by Clark County officials but the ballot never arrived at her home. The news outlet found out that the ballot was being counted and her name appeared on the active voters list even though she died of breast cancer in 2017.

“It hurts me to be honest with you,” Hartle told the outlet in November. “It doesn’t make sense to me, but it lends itself to what you hear in the media about these possibilities and now I’m wondering, how prevalent is it?”

The Nevada Republican Party cited Hartle’s case as one of many instances of voter fraud they said helped in the presidential election. An analysis by Nevada Secretary of State Barbara Cegavske (R) found that only 10 of the party’s more than 1,500 people who said they voted even though they died were cases of fraud, The Nevada Independent said.

Hartle is charged with voting in another person’s name, as well as voting more than once in the same election. Both penalties are punishable by up to four years in prison and a fine of up to $ 5,000.
