The judge again rejected Trump’s attempt to postpone the committee’s bid to Jan. 6 for his White House notes

In his most recent decision, the judge said his earlier reasoning dictated that he should deny Trump’s request for an interim injunction restraining the disclosure of records pending further legal action.

“This court cannot effectively disregard its own argument in denying injunctive relief in the first place to grant injunctive relief today,” Chutkan wrote.

The National Archives, which contains Trump’s records, aims to provide a small preliminary tranche to congressional investigators on Friday afternoon. But whether that move happened appears to be up to the U.S. Circuit Court of Appeals for the District of Columbia.

Trump’s lawyers have already appealed Chutkan’s decision to deny a preliminary injunction in the case. They are expected to file a motion later Wednesday for temporary relief that will prevent Archives from reversing the records as the appellate court and possibly the Supreme Court consider Trump’s privilege claims.

The first tranche of records Trump sought to block includes files from his former chief of staff Mark Meadows, as well as call and visitor logs. An additional set will be given to the committee in Nov. 26.

Chutkan heard last week oral arguments on Trump’s emergency effort to block the committee. On Monday night, before Chutkan ruled on the matter, Trump urged the judge to block early the impact of his decision to give him time to appeal before Friday’s deadline. But Chutkan quickly denied that request, calling it legally deficient, because he could not block a decision that had not yet been released.

In his 39-page decision on Tuesday, Chutkan again denied Trump’s efforts to delay the committee’s access to his documents, and said his role as a former president did not give him the power to repeal the sitting president on matters of executive privilege – specifically on a matter of extreme national importance.

“Presidents are not kings, and the Plaintiff is not a President,” he wrote.
