Mary Trump is looking to throw out Donald’s case against her, New York Times

Donald Trump’s nephew asked the state court on Thursday to drop the former president’s $ 100 million lawsuit against him and the New York Times.

Mary Trump’s lawyers have filed a motion to dismiss Trump’s lawsuit that stemmed from explosive news articles about his taxes and finances.

“This baseless case should be dismissed because it is a futile attempt to punish Mary Trump and Pulitzer Prize-winning journalists for publishing factual information of great public concern about the former President Trump, ”Theodore J. Boutrous, Jr., a partner at law firm Gibson Dunn, said.

“Sir. Trump has a long history of filing lawsuits to suppress freedom of speech and of the press, and it’s more than the same. The First Amendment and New York law prohibit such abusive lawsuits.”

In a 30-page motion, lawyers said Donald Trump’s lawsuit was the equivalent of a “strategic lawsuit against public participation” (SLAPP) limited by an “anti-SLAPP” law in the Empire State.

The former president’s case, filed in September, accused Mary Trump of leaking her tax records to the Times. Mary Trump and journalists Susanne Craig, David Barstow and Russell Buettner worked to obtain the records because of “a personal revenge,” the lawsuit stated.

Mary Trump’s lawyers wrote in their motion to dismiss that the lawsuit against them was “a clear attempt to punish her nephew and these journalists for disseminating factual information of great public interest about on Mr. Trump’s suitability for office and aspects of his personal and financial history that he has long sought to keep, to discourage them and others from reporting such information in the future. ” The Times won the Pulitzer Prize in 2019 for its coverage on Donald Trump’s finances and taxes.

Donald Trump accused his nephew of violating a non-disclosure agreement reached after a fight over the property of Fred Trump-the former president’s father and Mary’s grandfather. But Mary Trump’s lawyers said that under state law the deal would be “terminated at will” and could not be enforced because it did not explicitly say the deal was permanent.

The former president’s nephew allegedly shared his uncle’s documents that he received during the legal discovery during the estate battle.

Mary Trump admitted to a source in the Times and last year published a tell-all book called “Too Much and Never Enough: How My Family Created the World’s Most Dangerous Man.” He must seek attorney’s fees and damages, the dismissal motion said.
