The Trump-appointed judge said the former president was ‘wrong in law’ in seeking to block the House committee but was cautious about publishing documents.

A U.S. judge rejected a bid by former President Donald Trump to keep his tax returns from the House of Representatives committee, which ruled that Congressional legislative interest was more than any respect Trump should receive as a former president.

U.S. District Judge Trevor McFadden said in his decision Tuesday that Trump was “wrong in law” in seeking to obstruct the House Ways and Means Committee from obtaining his tax returns.

McFadden, who also said the committee chairman has the power to publish returns if he thinks it is appropriate, suspended his decision for 14 days, giving time for an appeal.

Trump was the first president in 40 years not to release his tax returns because he intended to conceal details of his wealth and the activities of his family’s company, the Trump Organization.

U.S. presidents are not required by law to release details of their personal finances, but every U.S. leader since Richard Nixon has done so.

The committee sued in 2019 to force the disclosure of tax returns, and the dispute lasted nearly 11 months after Trump left office.

Trump’s attorney Patrick Strawbridge told McFadden last month that the committee had no legitimate reason to see the tax returns and asked them in hopes of discovering information that could harm Trump politically.

Strawbridge did not respond to a request for comment on the decision.

House Democrats said they need Trump’s tax returns to see if the Internal Revenue Service (IRS) has properly audited presidential returns in general and to assess whether new legislation is needed.

“I am pleased that we are now one step closer to being able to conduct more thorough oversight of the IRS president’s mandatory audit program,” House Ways and Means Committee Chairman Richard Neal said in a statement.

McFadden, a Trump nominee, said the committee could accomplish its stated goal without publishing the returns.

He warned Neal that although he had the right to do so, “anyone can see that publishing the confidential tax information of a political rival is the kind of step that will return the plague to the inventor”.

“It may not be right or wise to publish returns, but the Chairman has the right to do so.”

The decision was a severe blow to Trump, who has fought hard to keep his tax returns private, despite promises in 2016 to release them.

Trump said the Democrat -led House of Representatives effort was politically motivated.
