Judge Trevor McFadden, a federal district court judge in Washington, DC, appointed by Trump, said “facially valid” congressional inquiries should not be blocked.

“A long line of Supreme Court cases requires great respect for congressional inquiries that are valid in the face. Even the special solicitude granted by former Presidents does not change the outcome,” McFadden wrote in a 45-page opinion. “The Court will therefore dismiss this case.”

While the decision is a win for House Democrats, it may be a long time before they receive Trump’s tax returns.

McFadden stayed on enforcing his decision for 14 days to allow the parties to the case to discuss next steps, and ordered the executive branch not to give House Democrats tax returns during that time.

If the parties to the case do not reach an agreement on next steps within 14 days, Trump can seek relief from an appeals court.

“This ruling is not surprising, it is clear that the law is on the side of the Committee. I am pleased that we are now one step closer to being able to conduct more thorough oversight of the IRS president’s mandatory audit program, ”he said in a statement.

Trump’s lawyer did not immediately respond when asked for comment.

Neal first requested Trump’s federal tax return in 2019, under a provision in the federal tax code stating that the Treasury Secretary would “issue” tax returns requested by the chairs of Congressional tax committees. If the Ways and Means Committee receives tax returns, it must look at them in a closed session, but it can vote to send a report to the entire House making some or all of the documents public.

Neal said he wants to see tax returns because the committee conducts oversight and considers legislation about how the IRS audits presidents. It is IRS policy to conduct mandatory audits of presidents, but this is not required by law.

The Trump administration rejected Neal’s efforts, arguing that the chairman’s request had no legitimate legislative intent. But the Biden administration has taken the opposite position, with the Department of Justice saying in July that the Treasury would need to be deferred to Congress.

Trump then sought in his personal capacity to block the Treasury and the IRS from returning tax returns to the Ways and Means Committee. The committee and the Biden administration sought to dismiss Trump’s statements, and McFadden on Tuesday sided with them.

In his decision, McFadden expressed reservations about allowing the IRS to issue Trump’s tax returns, but wrote that the former president was “wrong in law” in his efforts to block the committee’s request.

“It may not be right or wise to publish returns, but it is the Chairman’s right to do so,” the judge wrote. “Congress has granted him this extraordinary power, and the courts are disgusted with the second prophecy on the motives of congress or laws enacted. The Court will not do this here and therefore this case should be dismissed. ”

The decision comes as Trump is still battling ongoing legal battles in Congress over access to his personal and administration records.

An appeals court last week ruled that the Biden administration could transfer hundreds of pages of Trump White House records to the House Jan.
