Trump Lost Bid to Withhold Tax Returns From Congress

The decision from U.S. District Judge Trevor McFadden can still be appealed, but it marks a significant win for Democrats in more than two years of attempts to get Mr. Trump’s tax returns. Separate action will be required by the Procedure and Procedure Committee to make any of the documents public.

“Even if the former President is right on the facts, he is wrong in law,” the judge, appointed by Mr. Trump, wrote in a 45-page decision. “A long line of Supreme Court cases requires great respect for congressional inquiries that are valid in the face. Even the special solicitude granted by former Presidents does not change the outcome.”

An attorney for Mr. Trump did not immediately respond to a request for comment.

Unlike his recent predecessors and President Biden, Mr. Trump has not yet released his tax returns to the public. He complained about the Internal Revenue Service’s extensive auditing while running as president; the IRS automatically reviews sitting presidents.

Rep. Requested. Richard Neal (D., Mass.) Shared former President Trump’s tax returns and audit records in 2019, after he became chairman of the Ways and Means Committee. The tax code gives the Ways and Means chairman the ability to request any tax return from the Treasury Department and states that the Treasury secretary will issue those returns.

But the Treasury Department, then part of the Trump administration, refused to give the returns to Mr. Neal. Administration officials said doing so was illegal, arguing that Democrats intended to obtain the documents for political purposes, not for legitimate legislative oversight.

The committee sued, and the case lasted several months and years.

This year, however, the Biden administration reversed Trump’s position and said it would provide the documents. The lawsuit continued, with the former president fighting to block the Treasury Department from providing documents to Mr. Neal.

In his decision, Judge McFadden cited statements from Mr. Neal and House Speaker Nancy Pelosi (D., Calif.) Suggesting that their interest in Mr. Trump’s tax returns is more than potential changes. in the legislature that governs how the IRS audits presidents.

“True, the statements of Chairman Neal and Speaker Pelosi are likely to show mixed motives,” he wrote. “But those who preceded the Supreme Court are examining whether Congress has a valid legislative purpose, not if that is the only purpose.”

Mr. has not yet said exactly. Neal what he will do with returns and audit records when he receives them.

“This decision is not surprising; the law is clearly on the side of the Committee, ”Mr. Neal said Tuesday. “I’m excited that we will soon be conducting more thorough oversight of the IRS’s mandatory presidential audit program.”

Judge McFadden ended his decision by saying Mr. Neal could oversee IRS audits on presidents without publishing returns.

“Anyone can see that publishing the confidential tax information of a political rival is the kind of move that will return the plague of the inventor,” he wrote. “It may not be right or wise to publish returns, but it is the Chairman’s right to do so. Congress has granted him this extraordinary power, and the courts are disgusted to guess congressional motives or laws that enacted. ”

During the court hearings, government lawyers said they would not race to provide the documents before appeals were filed.

Called by the leading Republican on the Ways and Means Committee, Rep. Kevin Brady of Texas, the ruling troublemaker.

“The court empowers Democrats in Congress to arm the tax code for political purposes, which threatens the privacy of any American taxpayer who wants to target politicians in Congress,” he said.
