E. Jean Carroll Attorney: Donald Trump’s CNN Slurs Crossed The Line

Roberta Kaplan, an attorney for counsel columnist E. Jean Carroll, on Monday told MSNBC’s Rachel Maddow that Donald Trump’s slurs against her client during his controversial CNN town hall last week is definitely actionable.

Kaplan also teased an imminent development in another defamation lawsuit filed by Carroll against the former president stemming from defamatory comments he made in 2019, when he was still in the White House.

A Manhattan jury last week found Trump liable for sexual assault and defamation, and ordered him to pay $5 million in damages after Carroll claimed he raped her in a dressing room. department store in the 1990s and that Trump responded with insults and false claims that Carroll was lying.

A day after the verdict, Trump called Carroll a whack job and said he didn’t know her during a heavily criticized CNN event. The supportive audience at the town hall laughed off Trump’s comments, even laughing in response.

Maddow noted on Monday that Carroll and his attorney pressed Trump for accountability, but pointed out that he did it again, defaming himself live on CNN.

The one who calls you a liar. The exact same things the jury held him responsible for the day before, he did again the next day on national television, Maddow said. Is this how it should be? Do you think it could be actionable, if you file another lawsuit? Does it work the same way?

So, it’s definitely actionable, Kaplan replied. And here, cruelty will weaken him. He will not be able to escape this later. It’s unprecedented for someone to be held liable in defamation to continue to commit defamation, so there aren’t many cases we can look to for a playbook on how to do it.

But, suffice it to say, I have a lot of lawyers busy looking at it, and we’re weighing all our options, Kaplan added.

Maddow highlighted another pending lawsuit filed by Carroll against Trump, stemming from the 2019 slurs.

Kaplan suggested an early development in that case possibly two to three days, max saying we’ll be able to move forward on damages in that case.

We don’t even need a finding of liability, because we already have it, she explained. And we will find damages. And, there, the defamation damages are higher, because that was the first statement he made.
