Dubiously claimed by Sen. Ron Johnson (R-Wis.) on Sunday said former President Donald Trump did not pursue the prosecution of 2016 election opponent Hillary Clinton because it was in the best interest of America. (Watch the video below.)
In a discussion with Fox News host Maria Bartiromo on Sunday Morning Futures, Johnson refuted Trump’s federal indictment that he did not handle classified government documents stored at Mar-a-Lago.
The far-right lawmaker accused the press of overlooking the business dealings of the Biden family before offering a stark twist to Trump.
President Ford decided it was best for America not to pursue prosecution against President Nixon, Johnson said. President Trump almost made the same decision and decided not to pursue any kind of prosecution of Hillary Clinton. Joe Biden could have made the exact same decision but he didn’t.
He authorized a SWAT raid on President Trump’s highly secure residence on federal records, even though he himself holds the classified records. So the issue of record should be handled civilly. We should never be in this place. But these are decisions made by President Biden as likely as he is lying about not talking to the Justice Department. That’s a little hard to believe when you understand how many other lies President Biden has told in public.
Most of what he said did not pass a fact check.
Trump tried to have a special counsel investigate Clinton, but it never happened, according to PolitiFact. Former president Attorney General Jeff Sessions wants Clinton indicted for using a private email server while secretary of state.
Not to mention that the FBI had previously recommended against prosecuting Clinton in 2016, and a State Department investigation in 2019 found no compelling evidence of systemic, deliberate mishandling of classified information after she turned over thousands of emails.
Regarding Biden’s decision on Trump’s criminal case, Rep. Ted Lieu (D-Calif.) recently fact-checked Sen. Josh Hawley (R-Mo.) on similar GOP accusations:

Presidents do not imprison or indict anyone. Grand juries indict.
Trump has also been indicted in New York on charges related to hush money payments to porn star Stormy Daniels. The trial is scheduled for 2024.
