18 US Code Par. 2383 – Rebellion or insurrection establishes: Whoever incites, abets, aids, or engages in any rebellion or insurrection against the authority of the United States or its laws, or gives aid or comfort to it, shall shall be fined under this title or imprisoned for not more than ten years, or both, and disqualified from holding any office under the United States.
US Attorney General Merrick Garland has appointed Jack Smith as the special counsel overseeing the criminal investigation implicating Donald Trump in connection with the attack on the US Capitol on January 6. Given the potential crimes committed, the code appears to be appropriate on top.
The attack undoubtedly fits the definition of rebellion and insurrection to criminally nullify the constitutionally established winner of the presidential election.
Although not physically involved in the coup attempt, there is plenty of evidence to prove that Donald Trump personally aided and abetted the siege. For example, not only did Trump fail in any attempt to prevent armed protesters from swarming the Capitol, he initially rejected any effort to stop the deadly violence once it began.
His subsequent stated intention to pardon and apologize to those who participated in the deadly uprising should establish the additional evidence necessary to establish the aiding and abetting element of the law; thus, establishing his prior criminal intent beyond a reasonable doubt.
