Nirvana sued a child from the NeverMind album cover for alleging sexual abuse

The man depicted as a baby on the cover of Nirvana Nevermind’s album has launched legal action against the band, alleging the photo amounted to sexual exploitation.

The iconic album cover depicts a four-month-old baby in a pool, grasping a dollar bill dangling in front of him on a fishing line.

Spencer Elden, now 30, claims the nude photo of his young age is used in child pornography, and says his parents never signed a disclaimer allowing his photo to be used on the cover.

Mr. Elden claims that his “real identity and legal name are forever linked to the commercial sexual exploitation of which he was subjected as a minor and which has been distributed and sold around the world since he was an infant to the present day”.

He claims that he has “suffered and will continue to suffer lifelong damages” as a result of the album’s cover, including “extreme and lasting emotional distress” and “interference with his normal development and educational progression”.

Mr Elden is seeking damages of at least $150,000 (£109,000) from each of the 15 accused, including surviving band members Dave Grohl and Krist Novoselic and photographer Kirk Weddell.

Representatives for Nirvana and their record labels have yet to respond to the lawsuit.
