Environment Agency must do more to protect 5-year-old boy from landfill fumes, court rules | Environment Agency

The Supreme Court has ruled that the Environment Agency must do more to protect a five-year-old from landfill fumes that doctors say short his life expectancy.

In a judicial review, filed on behalf of Matthew Richards, lawyers argued that his respiratory health problems were exacerbated by fumes rising from a landfill near his home in Silverdale, near Newcastle-under-Lyme.

Exposure to hydrogen sulfide fumes from the site “would have a lifelong detrimental effect on Matthew’s future respiratory health” and reduce life expectancy, said Dr. Ian Sinha, Consultant Pediatric Pulmonologist at Alder Hay Children’s Hospital.

Activists welcomed the ruling, delivered by Judge Fordham Thursday morning, which said that although the CIA had not violated its legal obligations, it had not yet addressed its legal duties in the way it should.

The ruling stated: “There is a clear and urgent imperative in the public interest that you do so, as a matter of urgency.”
