Alec Baldwin will be charged with manslaughter over the 2021 death of cinematographer Helena Hutchins on the set of Rust.

New Mexico prosecutors announced Thursday that the actor is one of three cast and crew members facing accidental shooting charges.

David Holes, Rust’s first assistant director, has agreed to plead guilty to reckless use of a deadly weapon.

Meanwhile, the film’s creator, Hana Gutierrez Reid, has been charged with manslaughter.

Baldwin’s lawyer responded to the news in a statement to The Independent, saying: “This decision distorts the tragic death of Helena Hutchins and represents a terrible miscarriage of justice.”

Luke Nicas said they intend to “fight” the accusations and “win.”

The decision comes more than 15 months after the fatal shooting in October 2021, which occurred when a stent gun Baldwin was holding fired in place. One bullet hit director Joel Sousa in the shoulder before fatally hitting Hutchins in the chest.

Baldwin has repeatedly denied any wrongdoing and maintains that he was told the gun was “cold”, meaning it contained no live ammunition, and that he never pulled the trigger.

“The attorney general’s claim that an actor has a duty to ensure the functional and mechanical operation of a firearm on the production set is false and ill-considered. An actor’s job is not limited to being a firearms or weapons expert,” read the actors’ union statement, without naming Baldwin.

The statement continued: “Industry standards for safety with firearms and the use of blank ammunition are clearly set out in Safety Bulletin 1, which was presented by the Joint Labor Department Safety Committee at the industry level. The guidelines require that an experienced and qualified gunsmith be assigned responsibility for all firearm handling operations. These duties include “Inspecting the firearm and barrel before and after each firing sequence” and “Inspecting all firearms before each use.”

“The Guidelines do not make it the responsibility of the performer to inspect any firearm. Performers are trained to perform, and are not required or expected to be experts in guns or experienced in their use. The industry assigns this responsibility to qualified professionals who oversee their use and handling In every aspect. Anyone issuing a firearm must receive training and instruction in their Safe and Use Manual, but all firearm activity on a range must be under the close supervision and control of the professional gunsmith and employer.”
