SNP refuses to release transgender rapist from female prison

Some supporters of the legislation denounced the attempts as anti-transgender “dog whistles”.

However, Conservative MSP Russell Findlay said Bryson’s case had highlighted “fundamental flaws” in the barring legislation.

He added, “It is completely inappropriate, unacceptable and wrong that this despicable rapist should be housed in a women’s prison, which must contain women who are victims of male violence, violence and sexual assault.”

Mr Brown insisted the legislation made no difference to the SPS policy for the accommodation of trans prisoners, which “does not depend” on the possession of a Gender Recognition Certificate (GRC).

However, SPS chiefs have previously said that owning a GRC is a factor they take into account when deciding where to send prisoners. They have acknowledged that they may be subject to legal action if they refuse to accommodate an inmate in line with their legal gender.

Bryson does not have GRC but it would have been much easier to obtain it had the proposed SNP system been in effect.

Author JK Rowling has supported calls for Sturgeon to be questioned personally about Bryson’s case and has mocked the Prime Minister on social media.
