A Manhattan jury is expected to deliver verdict imminently in Ed Sheeran’s copyright trial.

The British singer-songwriter is currently facing a lawsuit by the estates of Ed Townsend, the songwriter who composed the slow jam classic “Let’s Get It On” with Marvin Gaye in 1973.

They accused Sheeran’s 2014 song of copying the anthem’s harmonic progressions as well as melodic and rhythmic elements without permission.

The lawsuit was initially filed in 2017, however, it took six years to finally reach a Manhattan federal court.

Sheeran vehemently denies plagiarizing “Let’s Get It On”. His lawyers argued that the song uses common structures found in many pop tracks.

If the “Perfect” singer is found liable for copyright infringement, the trial will enter a second phase to determine the amount he owes in damages.

He reportedly told the court this week that if he loses, he plans to give up music.

Meanwhile, it was revealed that Sheeran will temporarily replace Katy Perry on American Idol while she performs at the Coronation Gala in London this weekend.

The plaintiff’s attorney claimed he had a “smoking gun” in the case

Presenting his case last week, the plaintiff’s attorney, Ben Crump, said he had a “smoking gun”: a fan video from a past Ed Sheeran concert in which the singer performs a “mix” of “Thinking Out Loud” and “Let’s Get On.”

“This party video is a confession,” said Crump, who is best known for his portrayal of George Floyd’s family.

Sheeran’s attorney, Ellen S. Farkas, argued that the video did not prove copyright infringement, and that Sheeran often mashed up the images during his live performances.

Sheeran questioned his musical skills during the trial

Sheeran performed short lines from his song in court last week. He explained his songwriting technique to the jury, saying, “When I write vocal melodies, it’s more like acoustics.”

Sheeran has claimed that he often writes up to 10 songs in one day. He co-wrote “Thinking Out Loud” with Amy Wadge.

Sheeran says the other singers cheer him on

Sheeran said he has heard from other singers since the trial began because they share his concerns about facing litigation over their songwriting.

“When you write songs, someone comes after you,” Sheeran said.

Following the judge’s ruling, Sheeran released a video on social media speaking about the case, saying, “While we are obviously pleased with the outcome, I feel that claims like this are now very common and it’s become a culture where a claim is presented with the notion that it will be cheaper to settle than to refer it to court.”
