Outrage over the death of a homeless man in the New York subway
Subscribe to our free US Newsletter sent straight to your inbox every weekday morning.
A former US Marine who put Jordan Neely to a fatal chokehold on a New York City subway train has been identified as Daniel Penny in multiple reports.
The 24-year-old reportedly hired attorney Thomas Kenniff, who ran unsuccessfully as a Republican against Alvin Bragg for Manhattan attorney general in 2021. Mr. Bragg received more than 80 percent of the vote.
Manhattan prosecutors are investigating Neely’s death after the city coroner determined the 30-year-old, a Michael Jackson impersonator who was homeless, died from pressure on his neck. His death was ruled as murder. No arrests have been made.
The harrowing footage captured by journalist Juan Alberto Vazquez captured the deadly confrontation that erupted aboard the F train in Manhattan on Monday afternoon.
The incident sparked citywide protests calling for justice for Neely’s death, while federal, state, and local officials condemned the volatile political rhetoric surrounding homelessness and Mayor Eric Adams’ lack of urgency.

Nellie’s father, Andrew Zachary, told the New York Daily News that he hasn’t seen his son in four years.
But one thing stood out in his memory: Nellie’s “great” Michael Jackson impression.
“I sat him in front of the TV and showed him the Jackson 5,” Zachary said. “He took on Michael Jackson and shaped him very well…
Jordan was a good man. He was a good person who was brought up well. He always had a file [temper], but he was not used to hurting anyone. It wasn’t bad. It was nice “.
Speaking of his son’s performance as Michael Jackson, he said, “He was just like him. He used to perform on the block. Once upon a time, people loved him.”
Zachary said his son was deeply affected by the killing of his mother in 2007.
“He didn’t care after that,” he told the Daily News. “Once his mother died…they were so close. He loved her so much that he lost her. After we buried her, he just wasn’t the same anymore.”
Fox News anchor blames George Floyd for subway death
Fox News’ Greg Gutfeld blamed the death of Jordan Neely on the killing of George Floyd.
Neely’s death in a New York subway shocked and horrified dozens of Americans who blamed the accident on the dehumanization of black communities as well as homeless community members.
The death has also drawn comparisons to the killing of Floyd. However, Gutfeld had a different take on Nellie’s grisly death.
“If anyone says this is like George Floyd, no, it’s because of George Floyd,” he said on The Five on Thursday.
“Because since George Floyd, we’ve had the resulting chaos, defunding, police weakening – encouraged by the band, by the media, by the various media outlets, except CNN. It created the track and the void where I saw fewer cops.” “.
Nellie’s mother was murdered in 2007
Jordan Neely’s relatives have spoken out publicly after a 30-year-old homeless man was killed in a New York subway accident.
His father, Andrew Zachary, told the New York Daily News that Nellie’s mother was killed by her boyfriend when he was 18 years old, in 2007.
Christy Neely’s boyfriend was reportedly convicted in 2012 of strangling her and sentenced to three decades in prison.

Mentally ill people have long been treated indifferently. From this horrific tragedy we hope that comes a new commitment by our elected officials to address the mental health crisis on our streets and subways.

1683319725 Will a grand jury decide whether to press charges?
A grand jury could determine whether criminal charges were brought against the man who killed Jordan Neely on the Manhattan F train on Monday, according to officials who spoke with several New York outlets.
The Manhattan District Attorney’s office, Alvin Bragg, told The Independent that “highly experienced prosecutors” are investigating Jordan Neely’s death.
“This is a serious and serious matter that has ended in the tragic loss of Jordan Neely’s life,” said Press Secretary Douglas Cohen. As part of our rigorous ongoing investigation, we will review [medical examiner’s] reporting, evaluating all available video and photos, identifying and interviewing as many witnesses as possible, and obtaining additional medical records.”
A law enforcement official close to the investigation told ABC News that the case is likely to go to a grand jury next week for the commission to determine whether criminal charges are warranted.
Investigators have reportedly interviewed several witnesses and are looking to speak to “four or five others” who were close to the scene, according to ABC News.
ABC reported that Daniel Binney, the man who is believed to have appeared in a video showing his arm wrapped around Neely’s neck for several minutes before his death, had already provided a version of events to investigators.

Who is Daniel Penny?
On Friday afternoon, the media confirmed the identity of the man who was murdered by murderer Jordan Neely, after online investigators discovered his name Thursday night. Several news outlets, including The New York Post and The New York Daily News, attempted to reach him for comment earlier this week, but curiously withheld his name from the public.
According to his LinkedIn profile, Benny joined the US Marine Corp in 2017 after graduating from West Islip High School, about 36 miles outside of Manhattan.
Public records confirm an address at Marine Corps Base Camp LeJeune in Jacksonville, North Carolina.
He left the Marines in 2021. He wrote on a job site in the service industry that his military experience helped him discover that he was “passionate” about “helping, connecting, and connecting with different people from all over the world.”

Jordan Neely wanted to help. The brutal narrative of homelessness blamed him for his death
New Yorkers are no strangers to the disruptive people who ride the city’s 6,500 subway cars; Subway riders usually keep to themselves and ignore them.
But Jordan Neely’s death has revived the media’s volatile accounts of New York’s homeless population, prompting vigilante action to blame the person who killed him. The mayor and governor have not explicitly condemned the deadly violence, raising questions among New York leaders whether the city considers the life of a homeless black man to be of less value than a white stranger willing to use deadly force.
Advocates and lawmakers told The Independent that the deliberate and outspoken rhetoric surrounding people experiencing homelessness, exacerbated by prolonged failures of policies aimed at helping them, has exposed thousands of New Yorkers and vulnerable people across the country to the kind of vigilante violence that has killed Nellie.
