Britney Spears bodyguard Jimmy Spears is accused of using more than $2 million of the singer’s money to defend himself

Britney Spears’ bodyguard Jodi Montgomery criticizes Jamie Spears for claiming that she would not allow him to communicate with his daughter or be involved in decisions about her preservation.

In documents filed in Los Angeles court by Montgomery’s attorney, Lauren Wright, on Friday, the trustee convicted Britney’s father for trying to blame Montgomery for the singer’s alleged treatment under her ruling, which was revealed during an explosive court hearing in Britney on June 23.

“It is ironic that Mr. Spears now wants the guardianship to reflect her wishes, because it is no secret that Ms. Spears has been wishing her father out of her life for years,” she claims in the document.

Through her attorney, Montgomery also alleges that Jamie used “more than $2 million of his daughter’s money” to defend himself in an effort to remain guard of her property.

A representative for Jamie did not immediately respond to PEOPLE’s request for comment on the allegations.

Montgomery asserts in the file that it is impossible for Jamie to be ignorant of his daughter’s life over the past 21 months (since Montgomery has taken over as her persona), because “everything costs money”.

“No expenses could occur without going through Mr. Spears,” it continued in the document, adding: “Not all required expenditures were approved, which led to some of the concerns raised by Ms. Spears on June 23, 2021.”

Montgomery and Jamie must work as a team to ensure that Ms. Spears’ best interests are met, that she is on her way to recovery and ending her regency, and that she is living her best possible life. On Wednesday, Montgomery petitioned for a designated guardian — a third-party attorney — to help the pop star choose her attorney without having to undergo a medical evaluation, after her court-appointed attorney Sam Ingham III asked the court to resign.

In the lawsuit, Montgomery and her attorney said Spears “categorically disagrees” with Ingham’s request that his resignation become effective “on the appointment of a new court-appointed attorney.”

“After 13 years of being a court-appointed attorney, she wants to choose her own attorney,” the document reads. “At the June 23, 2021 hearing, Ms. Spears addressed the court and repeatedly expressed her desire to select her attorney without any further medical evaluation.”

The court file from Montgomery contained screenshots of which Spears — listed as Jane Doe — texts her, saying, “I need you to stay as my partner in keeping the person. I’m asking you to help you get a new attorney.” (Montgomery said on Tuesday that she would not resign because Spears had asked her to stay.)

The court battle over keeping Britney has escalated since she told the court in bombshell testimony that she never knew she could file to end her.

“I want changes, I deserve changes. I was told I should sit down and stay again,” she said in court, addressing the judge directly. “Madam, I didn’t know I could petition the guardianship to terminate. I honestly didn’t know that.”

“Frankly, I don’t think I owe anyone a rating,” she added. “I’ve done more than enough.”

Earlier this week, Larry Rudolph resigned as Spears’ manager, citing the singer’s desire to retire from music. Last week, the Bessemer Trust, which was named co-custodian of the Spears estate in November 2020, resigned from his position citing its desire to end the trust in general.
