LOS ANGELES (AP) Los Angeles Dodgers pitcher Trevor Bauer appeared in court Friday to challenge an extension of a protective order sought by a woman who says she strangled her to the point where she lost consciousness and hit her during two intercourse earlier this year.
Lawyers for Bauer and the woman revealed during a short hearing that they intend to call several witnesses, including Bauer, and discuss the order in what amounts to a trial that is expected to last. three days.
Judge Dianna Gould-Saltman has delayed the start of this hearing until August 2 because Bauer’s lawyer Shawn Holley said she received the woman’s witness list late and did not had not had time to prepare.
We came here ready, but ready on what was presented to us, Holley said in court.
Gould-Saltman ruled that Bauer will have to speak up and must decline to answer potentially incriminating questions one at a time, as is the norm in civil proceedings like this. She refused Holley’s request to let him avoid testifying completely. Holley said she strongly advised against Bauer saying anything.
Police in Pasadena, California are also investigating allegations of possible criminal charges, so it is critical for their legal team to avoid self-incrimination.
The judge extended the temporary restraining order preventing Bauer from coming into contact with the woman until the full hearing was over.
Pitcher’s agents Jon Fetterolf and Rachel Luba disputed the allegations. Fetterolf said in a statement that the couple’s brief relationship was completely consensual. The statement says Bauer has messages from the woman asking about the type of brutal sexual interactions they had.
Major League Baseball put Bauer on paid leave on July 2 under the joint policy on domestic violence, sexual assault and child abuse adopted by MLB and the players’ union in 2015. The leave has been extended until ‘to July 27 and could be extended.
The woman, from San Diego, said in court documents seeking the order that she and Bauer met on Instagram when she tagged him in a photo as he pitched in a game against the Padres in May.
She then visited her home in Pasadena and had sex which started out as consensual but turned violent without her consent, according to the documents.
The second incident, in which she alleges that Bauer hit her repeatedly, left her with two black eyes, a bloody swollen lip, bruises and severe scratches on one side of her face. She included photographs showing the injuries.
The documents indicate that she requested the order because Bauer repeatedly called and texted her after the second meeting to ask if she was okay, and she did not want any further contact with him.
Bauer’s agents said he had not made any contact with her for a month when the restraining order was first sought, rendering the decision without merit.
The Associated Press generally does not identify people who say they have been sexually assaulted.
Bauer agreed to a three-year, $ 102 million contract to join his hometown Dodgers earlier this year after winning his first Cy Young with the Cincinnati Reds last season. Bauer is 8-5 with a 2.59 ERA in 17 starts this season.
