As Vice President Mike Pence hid from the crowds entering the Capitol on Jan.6, Trump’s attorney John Eastman told Pence’s team they were to blame for the riot, according to one new Washington Post report.

Eastman made the comments in an email exchange with Pence’s senior aide Greg Jacob, who described the riot as a “siege” as he took cover with the vice president in a secure area. .

“Thanks to your bullshit we are now under siege,” Jacob wrote, according to the newspaper.

“The ‘siege’ is because YOU and your boss did not do what was necessary to allow this to be broadcast publicly so the American people could see for themselves what happened.” Eastman replied, referring to Trump’s false claims that the 2020 election was fraudulent.

In the days and weeks leading up to voter certification, Conservative jurist John Eastman took an active role in urging Pence to overturn the election by concocting various legal theories.

The vice president has reportedly refused on several occasions, arguing that he had no constitutional authority to do so.

As the Capitol Riot unfolded, Trump himself tweeted: “Mike Pence did not have the courage to do what should have been done to protect our country and our Constitution.”

Several rioters were heard calling for the execution of the vice-president.

Mike Pence has since said of Trump: “I don’t know if we’ll ever be okay on that day.”

In interviews with The Post, Eastman confirmed the contents of the emails to Jacobs but denied that he blamed Mike Pence for the violence on Capitol Hill.

Eastman argued that Trump’s team was right to exhaust “all legal means” to challenge the election results, which he said were rife with fraud.

“Are you supposed to do nothing about it?” Eastman told the newspaper.

On January 6, as the unrest began, Jacob emailed Eastman to commemorate his conversation with Eastman the day before, two people with knowledge of the matter told The Post.

When Pence and his team were escorted out of the Senate and to a safe place, Jacob again emailed Eastman criticizing the legal advice he had given Pence regarding the stopping of certification.

An anonymous individual familiar with the emails told The Post that Jacob later apologized for his use of profanity in the email to Eastman, but supported his criticisms.

Greg Jacob included Eastman’s email in a draft opinion piece he wrote in January but ultimately chose not to publish, which The Post obtained and published on Friday.

In the article, Jacob said that by sending this email an hour after the assault on the Capitol began, Eastman exhibited a “shocking lack of awareness of how these practical implications play out. in real time”.

Jacob further accused lawyers outside of Trump of weaving “a web of lies and disinformation, about him and the public” to pressure Pence to challenge the election results.

Jacob wrote that the legal profession should now consider whether the lawyers involved should be penalized for “using their credentials to sell a stream of snake oil to the world’s most powerful office, under the guise of advice from lawyer”.
