Waukesha’s Alderman forced to resign over allegations she lied about living in the district in which she served

WAUKESHA, Wis. (CBS 58) – A longtime Waukesha official has resigned amid allegations she lied about living in the district where she was elected to serve.

For over 20 years, Kathleen Cummings represented the people of Waukesha as alderman and as County Council Supervisor. This week Cummings was forced to resign for two seats.

Residents of Waukesha in District 9 have repeatedly elected Cummings to represent them.

“Well for her constituents, she was very tenacious and very focused when tackling an issue,” said Duane Paulson, Waukesha County Board Supervisor, District 17.

Roberta Avenue is where Cummings said she lived, but investigators allege she lived on Downing Drive in District 10. Her husband is listed as the owner of both houses.

“I am disappointed if the allegations are so and true,” Waukesha County Board Chairman Paul Decker of District 13 said.

Cummings has been on the board since the inception of Waukesha County Board Chairman Paul Decker.

“We’ve run into this a few times, but she definitely stood up for what she thought was right for the town of Waukesha,” Decker said.

According to the criminal complaint, water and electricity consumption at the Roberta Avenue address dropped significantly in 2012. A postman told investigators he noticed that letters delivered were piling up there. Cummings signed nomination papers in 2015, 2017 and 2019 – listing Roberta Avenue as his home address.

“I just can’t say enough about the passion and dedication she had for this job. It’s a shame it could end this way, but these aren’t issues I need to talk about,” Paulson said.

CBS 58 has contacted Cummings’ attorney, but has yet to hear back. A man answering a phone reported to him on Friday, November 12, declined to comment.

Statues in the state of Wisconsin require aldermen and supervisors to live in their district. Last year, the Waukesha city attorney presented a reminder note to the town council. He says Cummings didn’t ask for clarification.
