The defendant filed a petition accusing the investigator of asking for a bribe from his brother
The High Court on Monday ordered the Anti-Corruption Commission (ACC) to remove its deputy director, Md Alamgir Hossain, from the investigation into a case concerning allegations of demand for bribes.
The court also ordered ministerial and legal action against the investigator for contacting the accused’s brother by phone, which is unethical.
The High Court magistrate, Md Nazrul Islam Talukder and HM Mojibur Rahman, issued the order at a hearing on a motion for brief filed in this regard by the defendant in this case.
Alamgir Hossain was investigating a case filed by ACC against the former Deputy Registrar of Dhaka Sadar and sitting Registrar of Pirojpur District, Md Abdul Kuddus Howladar and his wife Mahinur Begum.
But recently Abdul Kuddus sent a letter to the ACC president alleging that Alamgir asked his brother for bribes for the case through a phone call.
Having received no response, he filed a lawsuit with the High Court.
On March 7, the court requested to submit the recording of the calls and the list of the telephone number of the applicant’s brother and charged IO Alamgir at a hearing.
As a result, the Bangladesh Telecommunications Regulatory Commission (BTRC) and Grameenphone submitted a report which showed a recording of multiple conversations between the two numbers.
The applicant’s lawyer, Mr Kamal Hossain, said: “If the phone call concerned an investigation, the OI would have spoken to the accused and not to his brother.
Following the report, the High Court summoned IO Alamgir, issued a rule, and set today’s date for the final hearing on the petition.
On October 22, 2020, ACC filed a complaint with the Dhaka Metropolitan Court of First Instance against Mr. Abdul Kuddus and his wife for concealing information about assets worth 24.70 lakh Tk, acquired assets worth 90.12 lakh Tk and have them occupied.
