HOUSTON – A 47-year-old medical representative has agreed to pay $ 100,000 to settle allegations that he helped submit false allegations, said acting US lawyer Jennifer B. Lowery.

Matthew Thibaut is a Cypress sales representative. He sold products through his company, Flex Surgical Management LLC.

From January 1, 2017 to December 31, 2019, Thibaut sold ANSiStim and Primary Relief devices to various medical providers. DyAnsys Inc. manufactures the devices that are used for electro-acupuncture. It only involves inserting needles into patients’ ears with the neurostimulator taped behind them with adhesive.

However, Thibaut’s clients falsely billed Medicare for the surgical implantation of neurostimulation electrodes. These are invasive procedures typically requiring the use of an operating room for which Medicare pays thousands of dollars. Thibaut would have known that his clients would bill Medicare in this manner and, as a result, helped provoke the submission of bogus claims, the allegations claim.

To date, the South Texas District has resolved six other similar cases, including settlements from anesthesiologist Katy, pain doctor from Houston, chiropractor from Rockport, chiropractor from Houston, d ‘a Pain Doctor from Laredo and a Pain Doctor from Woodlands. This is the first settlement in the Southern District of Texas involving an appliance distributor.

The United States Attorney’s Office jointly conducted the investigation with the Department of Health and Human Services – Office of the Inspector General. Assistant U.S. Attorney Brad Gray handled the case.

The claims resolved by the settlement are only allegations and there has been no determination of liability.
