Indictment raises new allegations in 2017

December 4 — A new indictment filed in a Hunt County murder case modifies allegations regarding the incident that resulted in the death of a local child four years ago.

A hearing is scheduled this week in state district court in the case against Brooke Ashley Craig.

Craig, 30, had previously been charged with capital murder and also faces lesser counts of murder and manslaughter in connection with the December 28, 2017 death of 7-year-old Kaden Green.

A second indictment on a charge of capital murder of a child under 10 was filed on November 19 by the Hunt County grand jury.

The charge, which was recently unsealed, eliminates the manslaughter count. Instead, the new indictment includes capital murder as count 1, alleging that Craig “intentionally and knowingly” caused Kaden Green’s death by shooting him with a gun. The new indictment is virtually identical to the wording alleging capital murder in the original indictment.

Count 2 of the new indictment alleges that the shooting was “in the course of and in connection with, or in the immediate escape, the commission or attempted commission of a crime, namely: fatal conduct”.

The fatal conduct indicated in the indictment alleged that Craig was involved in “knowingly discharging a firearm at or in the direction of a vehicle” and that she “was reckless as to whether the vehicle was occupied” .

Hunt County Assistant District Attorney Jeff Kovach said the charge was intended to replace the previous indictment and “gives the jury an opportunity to make a finding of criminal murder.”

Craig’s defense attorney Katherine Ferguson declined to comment when contacted on Friday.

The murder count in the original indictment also stated that Craig was shooting a gun with the intention of causing the death of Cameron Castillo. Castillo is not named in Craig’s new indictment, but still has two felony charges pending relating to events that occurred on the same day as Green’s death.

The story continues

Castillo was charged in March 2018 with one count of falsifying / fabricating physical evidence with intent to tamper with and illegal possession of a firearm by a criminal. He pleaded not guilty. He does not yet have a trial date set for the charges against him.

A review hearing on Craig’s two indictments is scheduled for Monday morning at the 196th District Court.

Jury selection in the case is scheduled for court on February 7, 2022.

If convicted of capital murder, Craig faced death by lethal injection or life in prison without parole. If convicted of murder, a first degree felony, Craig faces a sentence of five to 99 years in life.

Craig remains in custody at the Hunt County Detention Center, being held in lieu of a total bond of $ 1.3 million.
