The British Columbia Human Rights Tribunal has accepted a teacher’s amended complaint that the Delta School District discriminated against her because of her race.
The discrimination allegedly began in 2009 after Dr. Amritpal Andrea Dulay asked the vice principal of North Delta High School to stop calling Indo-Canadian boys “pieces of shit”.
The incident led to a meeting with union representatives regarding her harassment complaint.
Since 2009, Dulay has alleged that the district discriminated against her by giving jobs she applied for to white teachers with less qualifications, experience and seniority. Similarly, a department manager position she applied for remained with the existing employee who also had less qualifications, experience and seniority.
Despite his eligibility, Dulay also claims the district withheld district-funded educational leave.
She alleges that the district repeatedly improperly disciplined her on the basis of her race and subjected her to differential disciplinary treatment.
She said she was told to look for a job elsewhere, threatened on the phone to “leave the district” or it would become difficult for her, and yelled at and insulted during a union meeting.
The district moved to dismiss the complaint against the administrator and the principal. The court accepted.
However, the district said part of the amended complaint raised new allegations of “overt racism,” which it was previously unaware of.
“The school district says that had it been aware of these allegations, it would have ‘been given a break to consider its willingness to take responsibility’ in its motion to dismiss the lawsuit against the individual respondents,” Grace said. Chen, member of the tribunal, in his January 27. decision.
In September 2021, Dulay also filed a retaliation complaint against the district. The court has not yet accepted it for filing.
