Tan Beow Hiong, a 59-year-old woman who was caught on video making racist comments on an MRT train in 2021, has had all charges dropped.

According to The Straits Times, the charges against Tan were dropped after it was established that she suffered from a disorder in which she had the illusion that others intended to harm her.

In a statement, the Attorney General’s Office (AGC) said on Wednesday (December 14th) that Tan’s condition contributed significantly to his actions, and the prosecution decided to issue him a stern warning.

Following a pre-trial conference on December 13, the court granted Tan a discharge equivalent to an acquittal where she can no longer be charged with the same offenses.

Past

On April 21, 2021, Tan was filmed commenting on the race while riding an MRT train.

In the video, Tan was allegedly heard repeatedly asking the commuters about their race, and when the commuter said he was Malay, his response was, “Malay, right? Okay, no. amazing.”

She went on a rant about her college credentials, saying she was from Hwa Chong and Calgary, Canada, and was “not that stupid”. She even mentioned her family credentials, saying her brother-in-law is a CEO while her nephew is a lawyer.

She spoke loudly in the car, saying she was not racist.

According to the person who recorded the video, Tan pulled out his phone and began recording, counting the number of Malaysians in the train cabin. She said it was for the police and other commuters were harassing her.

After his explosion on the MRT, a YouTube channel named after Tan surfaced.

There were 29 videos uploaded on it. The first video was uploaded in December 2016.

Videos uploaded to the channel showed Tan making unsavory comments about strangers in public and filming them without their knowledge or consent.

Many of the people featured in his video were ethnic Malays or Indians who did not appear to have opposed Tan.

Most of the headlines accused others of harassing her, including one headlined “Indian sexually harassing 56-year-old Chinese woman.”

Shortly after, YouTube terminated Tan’s channel for violating the platform’s policies.

Details of Tan’s employment were later discovered and released online.

She was listed and registered as a seller of Knight Frank Singapore and after investigation was terminated from the property company.

Acquitted on all three counts

Tan faced three charges in 2021.

One charge of public nuisance and two charges of knowing acts of harm against the maintenance of harmony between different racial groups, likely to disturb the public peace.

Tan is acquitted on all three counts and given a stern warning for public nuisance and acts harmful to the maintenance of harmony between different racial groups, the AGC said.

According to AGC, the decision taken by the prosecution took into account three reasons, among others:

Tan was assessed as suffering from delusional disorder of a persecutory nature, which contributed significantly to her actions. Her disorder made her impaired in her social judgment and heightened any prejudice she might have against others.

Tan has no idea of his condition. She was unwilling to receive treatment under a court-ordered compulsory treatment order.

Tan had been remanded in custody for two weeks after being charged, and this period of pretrial detention would be taken into account by the court in sentencing her if she was found guilty.

“The Office of the Attorney General takes seriously any language or behavior that hurts any person’s racial feelings or undermines our racial harmony and community relations.”

The MCO warns that offenders who commit such acts will be dealt with accordingly.
