Buyers’ remorse is likely to take a more sinister turn in the months ahead as people who bought their homes at the top of the market take their frustrations out on their real estate agents. According to Victor Insurance Managers, historical precedents suggest that as home values stagnate and then fall, the latter group of buyers often become so irritated that they may lash out at their agents or other professionals involved. in the process.

The company, a leading provider of errors and omissions insurance policies for agents and brokers, says real estate companies should expect to see an increase in the number of lawsuits against their agents in the coming months. . When tempers flare, issues usually considered minor inconveniences can become major issues to argue.

As the company points out, agents who are prosecuted under these market conditions are no more likely to be convicted than they would at any other time. But that does not lessen the ordeal of defending oneself in court.

ADAPTATION TECHNIQUES

In today’s new home market, mortgage rate buyouts, upgrades and cash to cover closing costs are already the norm. Some builders even offer cash bonuses or higher commissions to agents who bring buyers to their doors. Now price cuts are imminent or already underway, says HomesUSA’s Ben Caballero. The Dallas-based brokerage lists new homes for sale for more than 60 builders in Texas’ four major markets.

Builders offer incentives and bonuses before lowering prices, Caballero told me. They are now lowering the prices.

Caballero knows a little about selling new homes: He’s a three-time Guinness World Record holder for most annual home sales transactions through MLS by an individual sell-side realtor. He is also the only agent to exceed $1 billion in annual sales, a feat he first achieved in 2015 and then repeated every year until 2018 when he nabbed over $2 billion.

SLOW FINISH

America’s New Home, this annual tribute to the latest building products and building techniques, battles toward the finish line. The centerpiece is rolled out each year at the National Association of Home Builders’ major convention, the International Builders Show.

The 2023 model is expected to debut at the show in January. But the homebuilder faces the same supply chain issues that all other builders face. In fact, the project sat virtually idle for more than three months in the spring waiting for the products to arrive.

Our biggest challenge has been figuring out when each of the products will appear so we know when to plan our work, said lead architect Michael Gardner. All of our (subcontractors) have been very busy, and because delays have become so frequent, no one will commit to a specific date until the product is on site.

As the flagship exhibition of IBS, the house has a difficult completion deadline. So to stay on top of tight installation schedules, Gardner says his team checks in weekly, if not daily, with vendors. It’s now gotten to the point where it looks like it’s more of a logistics company than a construction company, the architect said.

Despite significant delays, the project is on track for completion this month. The 7,575-square-foot show home features five bedrooms, seven bathrooms, a spa, game room, private office, state-of-the-art outdoor kitchen, rooftop deck, and two-tier pool.

NUMBERS GAME

Here are some random stats to note:

Nearly 60,000 sales failed in October, according to brokerage firm Redfin. This equates to a record 17.9% of homes under contract.

According to Alignable, an online listing network, some 37% of small property companies were unable to make their rents in October. Scary, sure, but even scarier is the fact that 37% is the national average among all small businesses.

Small businesses may still be the backbone of the homebuilding industry, but they are losing market share to regional and national companies. These large companies increased their market share to 57.5% in 2021, according to the National Association of Home Builders.

FLOOD INSURANCE

In a two-year change, the Federal Housing Administration now allows borrowers using FHA-insured financing to obtain flood insurance policies from private insurers. The FHA requires that properties located in special flood hazard zones designated by the Federal Emergency Management Agency have flood insurance. But flood cover is often advised beyond these areas.

The change now gives FHA borrowers an option: They can obtain flood coverage in the private market or through the National Flood Insurance Program. Private policies are usually, but not always, less expensive than those offered by the federal program and often offer better coverage.

The new rule is a win for consumers, for choice and for flood coverage that will protect more borrowers and property from natural disaster No. 1, said Kenny Parcell, president of the National Association of Realtors.

Accepting private policies shifts the risk from Uncle Sam to the private sector. But here’s the catch: Private companies must align their policies with the NFIP requirements or their policies will be rejected, even if they are acceptable for other federally guaranteed loans.
