Democrats consider right-to-work repeal, critics warn of consequences

Michigan Democratic lawmakers say repeal of the state’s Right to Work law is at the forefront of their agenda this term.

The 2013 policy prohibits making the payment of certain union dues a condition of employment. It was a major Republican priority at the time.

State Sen. Darrin Camilleri (D-Trenton) is sponsoring a bill to reverse some of those changes. He said the goal was for everyone to pay their fair share of negotiated benefits.

So when a union does its work on behalf of a factory’s entire workforce from which everyone benefits, that union also benefits from fair representation, Camilleri said.

The Camilleris bill and a similar one introduced in the House combine to apply to collective bargaining in public and private sector jobs.

But, in 2018, the US Supreme Court ruled against requiring public employees to pay union dues.

Camilleri argued that it was still worth repealing the right to work for public sector employees in the hope that another court would rule the whole line.

We hope and intend to repeal things that we know are no longer based on the state constitution or Supreme Court rulings in the event that the United States Supreme Court changes direction. notice on the road that our laws are ready so that workers can also make their voices heard in public sector unions, he said.

The power of unions in Michigan drastically diminished after the Right to Work passed as thousands of people left their unions.

The Democratic repeal plan would be a heavy political lift to undo those changes.

For one thing, only Indiana has legislatively repealed its right-to-work law since 1965. Another state, Missouri, reversed its law passed and signed into law in 2017 before it could go into effect.

Camilleri said he expected a lot of money to get involved in the Michigan fight.

The reason this right to work law was instituted in the first place was to undermine the power of workers, to make it harder to form unions and to keep unions going. Because when unions are organized, workers can fight for good wages, good health care, good benefits and safe workplaces, he said.

Democrats won narrow majorities in both houses of the Legislative Assembly last November. This means they will face a lot of opposition with only a few votes to spare.

Outside of business groups, some think tanks are also questioning whether it is worth repealing the right to work.

Critics have argued that this adds to a profiteering problem where someone can benefit from union negotiations without contributing to it.

But Jarrett Skorup of the Mackinac Center for Public Policy said there were better solutions than a repeal.

“We would support a law that says you can opt out of union membership and you can opt out of the contract. But the unions oppose that. They want people to be – whether they’re members or no – forced to pay union dues, he said.

Skorup said he sympathizes with those concerned about the issue of profiteering. But he said only a fraction of union dues is actually earmarked for collective bargaining to begin with.

Most of the time, unions want workers to pay the full cost of dues. So they want to pay for all other activity, meaning political activity, meaning salaries and benefits for all union employees, Skorup said.

His main concerns with the Democrats’ effort come down to the personal freedom aspect of demanding workers pay and the economic impact he expects that to have on Michigan.

Skorup said this could have a particular impact on the manufacturing industry.

There are a lot of studies looking at income growth, employment growth, population growth. And we think that in general they find right-to-work laws to be positively associated with income growth, employment growth and population growth, he said.

While Democrats have introduced repeal as part of their first bills of the legislative session, they have not set a timeline for getting it passed.
