Blame Police Hesitation For Pelosis Injuries; Plenty of time to shoot once danger has been presented
Police reluctant to take blame for pelose injuries
WASHINGTON, DC (January 27, 2023) Dramatic video of the brutal hammer attack on an elderly Paul Pelosi by a much younger would-be killer suggests unreasonable hesitation by police was a major factor in the life-threatening injuries of Pelosis, suggests public interest law professor John Banzhaf, who has analyzed numerous shooting cases.

Some 15 seconds appear to have elapsed between the time police first saw Pelosi in his pajamas grab a hammer from the hand of a much younger intruder and the blow that could have been fatal, but police n did not fire a single shot at the other man.
Some 9 seconds after the door is opened and the scene with its deadly risk is clearly presented, the police are obviously aware of what is happening – or at the very least that the young man is holding a deadly weapon very close of the eldest – and therefore orders him to drop it.
When the intruder refuses to do so, the police do nothing at the time to stop him from attacking Pelosi with the hammer.
Even after the intruder clearly and expressly refuses to comply with the police order to drop his weapon by saying “no”, the police still do not fire.
Then several seconds pass after his verbal denial before the intruder finally swings the hammer at Pelosi’s head, and yet, even at this late hour, the police are still not firing.
Instead, they waste a critical second or two for multiple officers to rush into the room and eventually subdue the intruder by physically subduing him.
Police reaction time
Numerous studies have shown that it can take a second or two from when a police officer first observes a deadly threat (and perceives it as such) to being able to aim their gun accurately and press on the trigger.
This inherent reaction time is why police are trained not to necessarily wait for a suspect to draw and point a gun, but rather to shoot before it happens.
That’s why the police shouldn’t have waited about 15 seconds after first seeing through the open door a situation in which a suspect – who is obviously not a carpenter carrying out repairs from last night – is holding up a lethal weapon.
It probably shouldn’t have taken them about 9 seconds to act; in this case, ordering the suspect to drop the hammer.
Even more clearly, suggests Banzhaf, the police should have shot the intruder – possibly even in the leg since they appear in the video to be close enough to do so – once he clearly refused to comply with an order from the police to drop a deadly weapon, and especially after Pelosi begins to struggle with the intruder for protection.
Banzhaf suggests that there is a clear distinction between a suspect who does nothing in response to a police request to freeze, show his hands, drop a weapon, etc. react fairly quickly, etc. – and a very different suspect defiantly refusing to drop what is clearly a deadly weapon (not a wallet, cellphone, etc.).
Although Banzhaf suspects that for various reasons Pelosi will not sue the police for negligence that contributed to his injuries, this unreasonable reluctance by police to take effective action to prevent a near-fatal attack on an elderly resident should be of concern to all residents. from his neighborhood, suggests the law professor.
