Abroad Tag: The BAR association defends Joshi; Joshi calls ‘false and baseless allegation’

Pakyong, Feb 01: Sikkim’s Additional Advocate General Sudesh Joshi resigned on Feb 1 following a public backlash against a Supreme Court observation regarding the Nepalese community in Sikkim as immigrants, according to the ‘Hindu. In a letter to the Chief Secretary, Mr. Joshi cited false and baseless allegations against him as the reason for his resignation, stating that his conscience did not allow him to continue in his current position. Although he denied any malpractice, political parties in the state criticized Joshi for not sufficiently informing the court about the distinction between the Nepalese population and other settlers in Sikkim. The state government has taken steps to file a petition for review to address the concerns of the Nepali community. Income Tax Act to include income tax exemptions for Indian citizens who were domiciled in Sikkim before 26 April 1975.

In the latest development of the matter, the BAR Association of Sikkim defended AAG Sudesh Joshi in a press release, claiming he was wrongfully defamed.

In order to create a pleading on behalf of a client, they continue, a lawyer must first obtain their instructions. Accordingly, it is inappropriate to criticize lawyers for filing court documents. Attorney Joshi did not represent any party in the case after being appointed as additional general counsel.

The Bar Association has also expressed concern over the Supreme Court’s labeling of Nepalis from Sikkim as “persons of foreign origin” and offered all its assistance in overturning the mislabelling.
