Assault allegation against cricketer Prithvi Shaw is false: Police inform court

Mumbai: Social media influencer Sapna Gills’ allegation that Indian cricketer Prithvi Shaw sexually assaulted her at a pub in Mumbai’s Andheri suburb is false and baseless, police have told a court on Monday.

The investigator appeared before the magistrate handling the case on Monday and filed a report on the case.

After the police submitted the report, Gills’ lawyer, Ali Kaashif Khan, asked the court to allow him to show the video footage of the alleged fight that a friend of Gills had recorded on his phone, which became viral in the media. He also asked for a CCTV capture of the incident which happened outside the pub.

The court asked the police to submit footage of the entire incident and adjourned the case to June 28.

Gill had filed a complaint in a Magistrates Court in Andheri seeking registration of the FIR under Sections 354 of the IPC (Assault or criminal force against a woman with intent to outrage her modesty.), 509 (Word, gesture or act intended to insult a woman’s modesty) and 324 (Willfully injured by weapons or dangerous means) against Shaw and his friend Ashish Yadav for assaulting her with a bat in February.

Before moving the court, Gill had approached Andheri Airport Police Station to register an assault case against the cricketer and his friend.

Police told the court that review of CCTV footage from the pub shows Gill and her friend Shobit Thakur were drunk and dancing.

Thakur wanted to record Shaw with his cell phone but the cricketer stopped him from taking videos. From the footage, it does not appear that Shaw and others assaulted Gill in any way, police said.

Police said they recorded statements from witnesses present at the pub where the alleged incident took place and they said no one touched Gill inappropriately.

Police also reviewed CCTV footage from the nearby air traffic control (ATC) tower, and the social media influencer is seen following Shaw’s car with a baseball bat in his hand . Footage shows she smashed the windshield of the cricketers’ car, the court heard.

The report also mentions that the police recorded the statements of the CISF officials and that they too stated that no such incident had taken place, as claimed by Gill.

According to a CISF official, they were alerted to a scuffle in the area. When he got there, he saw the windshield of a car shattered. The driver of the car said an argument broke out inside the pub and the manager asked them to leave and wanted to file an FIR, the report said.

The official saw a woman holding a baseball bat in her hand. His friend took the bat from him and threw it aside when they saw the police approaching the place. None of the men at the scene assaulted the woman, the report said citing the CISF official’s statement.

Investigation pursuant to Gill’s complaint has found the allegations against Prithvi Shaw and others to be false/baseless, police said.

Gill was arrested in February along with others in connection with an alleged attack on Shaw following an argument over selfie clickers at a suburban hotel.

After securing bail, Gill approached the airport police station with a complaint against Shaw, his friend Ashish Yadav and others, for alleged assault and outrageous modesty.

She later moved the court after police failed to register a case against the cricketer.
