A retired Buffalo priest who is accused of child sexual abuse in two recent lawsuits under the Child Victims Act has been placed on administrative leave.
Bishop Michael W. Fisher suspended Bishop James G. Kelly from his active ministry on Wednesday after an anonymous complainant said in court documents that Kelly assaulted him from 1980 to 1982. The complainant was a student aged 8 to 10 years of the Diocesan Educational Center. and attended church in St. Nicholas and St. Benedict the Moor at the time of the alleged abuse. The school and the two parishes have now disappeared.
The Diocese of Buffalo is launching a monitoring program that will include monthly home visits and other restrictions for violating priests.
Kelly, 83, was also charged in a June 11 trial by an anonymous complainant of having unauthorized sexual contact with a minor from 2005 to 2007 while assigned to St. Margaret’s Church in North Buffalo.
Diocese officials said in a statement that the original complaint was not served on the diocese and was discovered during a search for publicly filed complaints. The diocese said it informed the Erie County prosecutor’s office of the complaint and referred it to a review board that will appoint an investigator.
Kelly’s attorney, Joseph G. Makowski, said the Bishop denies abusing the children.
A CVA lawsuit accuses priests of providing an Orchard Park elementary school student with access to four girls and encouraging children to participate in sexual acts.
“Bishop Kelly has served our community with distinction for the past 59 years. We vehemently deny the allegations contained in the recent complaints,” he said.
