Breytenbachs Immigration Consultants has indicated another way to immigrate to the UK for people who are married or in a relationship with a UK passport holder.
Those struggling to meet the stringent financial requirements of a UK spousal visa should consider the Bailiwick of Guernsey as an alternative option, he said.
The Bailiwick of Guernsey (Guernsey) is a dependency of the British Crown and the second largest of the Channel Islands. Although not part of the UK and having their own jurisdiction, these Crown Dependencies are closely linked to the UK.
The UK government also governs some of its aspects of international relations. Guernsey is idyllic, with stunning landscapes and a very pleasant climate, said Breytenbachs.
Guernsey as an alternative to the UK spouse visa
If you are married or in a relationship with a UK passport holder and wish to emigrate to the UK, you are eligible to apply for a spouse / unmarried partner visa. However, you have to meet very strict financial requirements.
If, on the other hand, you prefer to emigrate to Guernsey instead, you will still apply for an unmarried spouse / partner visa in the same way you would for a UK unmarried spouse / partner visa.
However, there is no NHS to pay as part of your application. Plus, you don’t have to meet the same strict financial requirements as in the UK. All you have to do is prove that you can maintain and house yourself properly.
Right of residence in the United Kingdom
Another advantage of emigrating to Guernsey as the spouse of a UK passport holder is that you can still travel freely within the common travel area. The common travel area includes the United Kingdom.
Interestingly, time spent in one of the UK Crown Dependencies is not considered to be time spent outside the UK for the purposes of applying for an indefinite residence permit.
Therefore, after completing five years of residency in Guernsey on a spouse / unmarried partner visa, you may qualify to apply for indefinite residence leave, citizenship, and then a UK passport.
You will then automatically have the right to stay in the UK. Having the right to reside in the UK will automatically give you the right to live and work anywhere in the UK.
