Lawyers who helped Trump frame the election face increased risk of lawsuits | Attack on the US Capitol

Four lawyers who gave Donald Trump false legal advice that helped his bid to overturn the 2020 US election now face the increased prospect of criminal charges after a House panel released a comprehensive report on insurrection on Jan. 6, and referred lawyers for possible prosecution to the justice department, former federal prosecutors said.

John Eastman, Jeff Clark, Rudy Giuliani and Kenneth Chesebro played overlapping roles, offering Trump a bogus legal cover that included promoting a voter fraud scheme to replace voters Joe Biden was won by those for Trump, in an effort to block Congress from certifying Biden on January 6.

The lawyers’ actions and schemes were cited in an 845-page report last month by a House select committee investigating the events of January 6, and in referrals to the justice department, for providing others’ t different kinds of legal support for Trump that enabled parts of his attempted coup.

The report accused Trump of criminal involvement in a multi-part conspiracy, and cited four criminal offenses: making false statements, obstructing an official proceeding, conspiracy to defraud the United States, and aiding or abetting comfort in the insurrection, all of which were referred to the DoJ for prosecution.

The specific referrals to the DoJ were quite different for the four attorneys. They were all indicted for conspiracy to defraud the United States. Except for Giuliani, the other three were cited for conspiring to obstruct an official proceeding, a reference to Congress confirming Biden’s victory on January 6th.

Some of the legal methods used by lawyers to promote Trump’s botched coup are detailed in the referrals and in the panels’ complete report. For example, Eastman, a law professor in California, authored a coup memo suggesting ways former vice-president Mike Pence could take to help Trump reverse his election loss, including unilaterally throwing out some votes in the state’s electoral college.

Along with Giuliani, Eastman also addressed the Stop the Steal rally immediately before the attack on the Capitol, where he floated a baseless conspiracy theory about secret folders on voting machines that helped cast votes for Democrats.

The panel’s report and referrals also noted, that Clark, acting head of the DoJs civil division, was singled out as a participant in the conspiracy to defraud the United States. The report cited evidence that Clark drafted a letter with false information urging several state officials to name new voter rolls, as part of a plan involving Trump to install Clark as acting attorney general at the DoJ.

Last summer, Clark and Eastman had their cellphones seized by federal agents, in an early indication of the serious investigation prosecutors are giving them.

Giuliani, who served as Trump’s personal lawyer and pushed his false claims about widespread election fraud, was subpoenaed by the US attorney in DC in November to testify and provide documents about his payments from to Trump and his campaign, according to a Reuters report this week.

Although the House panel’s referrals to the DoJ are only recommendations and do not require the filing of charges against the attorneys, former prosecutors say the overwhelming evidence that they colluded with Trump to prevent Biden from taking office is may help prompt DoJ legal action against them.

The corrupt involvement of lawyers in various aspects of the January 6 insurrection is surely one of the low points in the history of the American legal profession, said former DoJ inspector general Michael Bromwich.

From filing bogus lawsuits, to trying to hijack the justice department, to concocting fake electors schemes lawyers are at the center of illegitimate attempts to keep Donald Trump in power. Any lawyer who cares about the reputation of the profession should be disgusted by their behavior, and hope they are held accountable by the very legal system they abused.

Other former prosecutors have offered grim views about Trump’s legal loyalists.

While professional status often shields lawyers from criminal liability, I expect prosecutors to use it as a sword here: this guy knows congressional procedures and invented an attack on the vulnerable area, leading to many others that are less well known, said Daniel Richman, a former federal prosecutor who is now a professor at Columbia law school.

While there may be prudential reasons not to criminalize Trump, those do not argue against charging this group with a conspiracy to defraud the United States. That broad title of violation doesn’t often capture the conduct of the defendants charged here, but it certainly does here, and a full factual presentation of this conspiracy might also reveal Trump’s own role. .

Similarly, Michael Zeldin, an ex-DoJ prosecutor, said: The January 6 committees referred to the DoJ about the role played by Trump-aligned lawyers in launching the attack on the Capitol laid out a compelling case .

[The] The DoJ now has to test that evidence against a standard of guilt beyond a reasonable doubt to determine whether charges are warranted, he added.

Eastman and the other lawyers accused in the House panels referred to the DoJ have all denied wrongdoing. But before the panels’ referrals and reports, evidence was mounting about the outsized roles Eastman and other lawyers played in advancing Trump’s conspiracy to block Biden from office.

Federal judge David Carter in March in a key decision involving Eastman, declared that Trump more likely than not broke the law during his weeks of trips to prevent Biden from taking office.

Dr. Eastman and President Trump launched a campaign to subvert a democratic election, an action unprecedented in American history, Carter wrote in a civil lawsuit that led to an order for Eastman to release more than 100 emails he withheld from the House panel.

Last year’s panel also heard stunning testimony from Greg Jacob, Mike Pences adviser. Jacob testified that Eastman admitted to him that he knew that his efforts to deny Pence to deny Bidens winning electoral college count would violate the Electoral Count Act, and that Trump, too, knew that it was illegal to Pence blocks Bidens certification.

Clark’s role in trying to help Trump promote false claims of election fraud also prompted strong condemnation at a House panel hearing last year. Former acting deputy attorney general Richard Donoghue took pains to recount Trumps efforts to replace acting attorney general Jeffrey Rosen with Clark in late December 2020, to increase pressure on state lawmakers to reject the Biden’s electors by pushing baseless allegations of massive fraud.

Donoghue testified that he warned Trump in a rare White House meeting on Jan. 3 that drew Rosen, Trump White House counsel Pat Cipollone and other top lawyers. Elevating Clark to acting AG would spark mass resignations, and leave Clark in charge of a grave, DoJ, Donoghue said

Cipollone, who testified before a federal grand jury last fall, also threatened to resign if Trump replaced Rosen with Clark.

Former Georgia US attorney Michael Moore said he believes the panel assembled a substantial case against some of Trump’s top loyalist lawyers, who were actually involved in an unprecedented and illegal effort to bring down the election, giving false legal arguments as part of the conspiracy.

A lawyer who tells his client how to open a vault is as guilty as a robber who breaks into a bank, Moore added.

However, Richman warned that DoJ prosecutors face challenges before charging any of the lawyers.

I suspect that prosecutors want to more clearly nail down the degree to which these lawyers are truly aware that their theories lack the slightest factual support or legal basis. It helps, but may not be enough, many around them say.

Regardless of whether or not the DoJ charges some of the lawyers, they should all suffer professionally for scheming with Trump, Bromwich insisted.

While it is not yet clear which of the lawyers will be found guilty beyond a reasonable doubt in the criminal prosecutions, they should all be outcasts in their chosen profession, and at the very least never practice law again. .
