The US House Select Committee investigating the Capitol riot is preparing to vote on urging the Justice Department to pursue criminal charges against former President Donald Trump, according to US media reports.

Politico reported Friday that proposed charges against Trump include insubordination, citing two anonymous people familiar with the matter.

The committee, made up of seven Democrats and two Republicans, will vote on its report and the criminal referrals on Monday.

While the congressional committee cannot bring legal charges against Mr. Trump, it can decide on a criminal referral to the Justice Department, if members so choose.

A referral does not necessarily mean that the Department of Justice, which is conducting its own investigation into the riot, will decide to press charges.

The committee is investigating the storming of the US Capitol that saw thousands of Trump supporters march on Congress on January 6, 2021 in a failed attempt to overturn Trump’s defeat in the 2020 election.

The committee’s public hearings, in which it grilled former Republican aides and key White House staffers about the lead-up to the riot, have highlighted Trump’s role in sparking an unprecedented attack on the Capitol.

The committee summoned the former president at the end of his last public hearing in October.

He initially said he would comply, but then sued to avoid testifying or providing any required documentation, and refused to appear for testimony.

Five people, including a police officer, were killed during or shortly after the riot and more than 140 police officers were injured.

The attack sent politicians running for their lives as people smashed windows.
