Britney Spears’ Lawyer Resigns From Controversial Preservation Program – Deadline

Less than 24 hours after Britney Spears’ longtime manager resigned, the singer’s court has appointed a lawyer and law firm that wants to break out of the restrictive tutelage that has dominated the former pop princess’s life and career for the past 13 years.

“Samuel D. Ingham III hereby resigns as court-appointed counsel to Britney Jane Spears, Governor, effective upon appointment of a new court-appointed attorney,” said the suit today in Los Angeles Superior Court by Ingham (read it here). The proposed exit of Ingham is accompanied by a move by Loeb & Loeb to leave the tutelage as well.

As with the withdrawal of wealth management firm Bessemer Trust last week as the co-custodian of the financial side of Spears’ more than $50 million fortune and career, the attorney’s and law firm’s resignations must be approved by Judge Brenda Penny, who has been overseeing the matter of multiple wills over the past several years.

The Bessemer Trust, which was opened to handle the financial matters of the younger Spears jointly with her father, confirmed on July 1 that it had “listened to the Conservatee and respected their wishes” in seeing the arrangement terminated or change. In fact, the Bessemer Trust revealed that they thought Britney Spears wanted to get them involved and agreed to a guardianship – which she clearly didn’t.

After a number of overt and secret incidents in the dark years of George W. Bush’s presidency, Spears was under punitive guardianship in 2008. Since the unusual arrangement was put in place, Spears has had little control over her career, personal affairs, medical concerns, and finances, And at least according to deeply disturbing statements she made in court on June 23 over the phone, even her body — which contains the IUD that Britney Spears wants removed.

At the same explosive DTLA hearing, the 39-year-old explained that she felt either misled or left in the dark about her true rights under guardianship and California law. The “Toxic” singer also noted that while she loved Ingham, she wanted to be able to decide for herself who her actors should be and not let them control her.

In the 20-minute appearance, Spears bluntly said, “I want my life back…I really think this guardianship is abusive…I want to end the guardianship without evaluation. I want to petition to end the guardianship.”

The singer has expressed that she only recently learned that she can file papers to end or dramatically change guardianship, which is dominated by her estranged father, Jamie Spears. Notably reeling from his client’s revelations, Ingham noted that he wasn’t sure how long Spears would represent when asked about some regulatory and follow-up inquiries by Judge Penny. However, even with all the lights on the guardianship and Spears’ remote appearance and strong statements in court on June 23, there were no official papers brought to court by Spears or her representatives to deal with the actual guardianship.

Behind the scenes, it was assumed that attorney Ingham was very upset about Spears’ characterization of their relationship and what he did and did not tell her, a source close to the events told Deadline. Although Ingham has been appointed to his role by the courts, the attorney privately maintains that he has always had Spears’ best interests first – although those best interests may just be the sticking point here.

A replacement attorney may be appointed by or during the next hearing on the matter, which is scheduled for July 14. However, before anyone could raise their hopes that this house of cards was about to collapse, Judge Penny last week rejected Ingham’s petition to Spears seeking to have her father removed from custody… and that was after the singer’s personal appeal to the courts for her release. In a potentially telling move, the elder Spears early last week entered papers in court demanding an investigation into his daughter’s “serious allegations” about how her life was being restricted – even though the younger Spears is putting much of this on his doorstep.

In contrast, even though some are picking up on the Spears for the June 23 session, assistant guard Jodi Montgomery, who has been in charge of the singer’s medical affairs and the like since 2019, isn’t going anywhere.

“She remains committed to steadfastly supporting Ms. Spears in every way possible in the scope of her duties as the person’s trustee,” licensed private professional trust attorney Lorraine Wright said in a statement Tuesday. “Miss. Spears has asked Mrs. Montgomery to continue to serve until yesterday. Mrs. Montgomery will continue to serve as regent for as long as Mrs. Spears and the court desire to do so.”
