50 Cent: Defense in penis enlargement lawsuit blames The Shade Room

50 Cent has been accused of accusing the wrong entity of spreading false information that he underwent a penis enlargement procedure.

Lawyers for Angela Kogan, the owner of the MedSpa named as a defendant in the ongoing 1950s lawsuit, countered the rapper’s claims by pointing the finger at The Shade Room instead.

According to court documents obtained by AllHipHop, the defense claims rumors of her alleged procedure spread due to the gossip outlet posting a photo of Fif and Kogan together.

The plaintiff is not entitled to relief against the defendants because the plaintiff did not properly plead against the offending party; namely, The Shade Room, according to the documents. The Shade Room authored the article and pulled the photo from Kogans’ social media without permission or consent from Kogans.

He continued, “The Shade Room is the publisher of the article, and Plaintiff has improperly applied The Shade Room’s actions to Defendant.”

The Queens legend filed a lawsuit in September, alleging that Angela Kogan and her Perfection Plastic Surgery & MedSpa used a photo taken by 50 at the facility to suggest he was a client and had undergone some kind of penile procedure.

Kogan denied the allegations against her and her company and wasted no time in seeking the dismissal of the case arguing that 50 Cent was a client and agreed to use the image as payment for the work he would have done.

In addition to her claims, Kogan also claims that the Instagram post using the photo of her and 50 was meant to thank the rapper for visiting her office and not endorsing it. The G-Unit boss, meanwhile, said he only agreed to take the picture because he thought Angela Kogan was a fan.

In the latest filings, the service provider and its attorneys also argued that 50 owed no compensation because he was not the rightful owner of the photo in question. Kogan further states that while she was being interviewed by The Shade Room, the site chose to use the photo of her and 50 Cent without her permission.

The defense previously asked federal judge Robert N. Scola, Jr. to dismiss the lawsuit altogether, based on his allegation that the photo was used as a form of payment. Judge Scola wasn’t buying it, calling his argument simply bogus and choosing not to dismiss the case.

As the saying goes, a picture is worth a thousand words, writes Scola. This one in particular depicts a global celebrity next to Kogan with the name MedSpas repeated throughout the background. The promotional value is obvious.

He added: Read in the light most favorable to Jackson, the defendants’ thanks serve as a humblebrag. This is self-promotion, as a definition of the word humblebrag was added to the ruling.

A trial date had been set for July 3, 2023, but it is still possible that the parties involved will reach a settlement before that date.
