Washington, DC – The United States Court of Appeals has ruled that the federal government bears responsibility for causing atypical recurring flooding that has damaged farms and properties in the Missouri River Basin since 2007.

Originally filed in 2014, plaintiffs in the case include more than 370 landowners from Iowa, Kansas, Missouri, Nebraska, North Dakota and South Dakota. Seth Wright, the plaintiffs’ lead attorney, said while some landowners were frustrated with the length of the case, they were happy with this latest decision.

Wright says the plaintiffs’ primary allegation was that modifications to the river by the U.S. Army Corps of Engineers as part of the Missouri River Reclamation Program (or MRRP) caused flooding along the river, which the court also ruled violated the 5th Amendment.

Wright says it was a massive victory for the decision to favor their cross-appeals, including compensation for crop losses, damage from the 2011 floods and the value of the permanent flow easement on the properties. owners affected.

Wright says it’s unclear whether the federal government will choose to appeal the decision.
